Wife's B1/B2 Tourist Visa Expires in 2 weeks, I-485 sent last, how long for Notice of Action letter?

My wife's tourist visa expires in 2 weeks and is currently in the US. She sent a I-485 application with a copy of pending I-130 petition from May of this year, along with supporting documents last week.

I'm hoping she a NOA-1 for her I-485 packet, which will put her in legal status after her tourist visa expires within the next 2 weeks.

Should this window be long enough to get a NOA-1 for her I-485 before the tourist visa expires?

Please advise.

Yes, it should be. Note that overstay for the spouse of a US citizen is forgiven in the AOS process...so even if the NOA is not received (issued, really, is the important date), she's OK.

you may not get the letter back in time,

but

is high probability the date printed on the letter is within her authorized stay period.

That'd be stellar, if'n so.

Still, at the end, any overstay is forgiven automagically when the greencard application is approved.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

The I-485 application arrived at Chicago lockbox (express mail address) on Friday. They didn't cash the check yet, but very excited to hear all the positive feedback. :)

Our check for AOS was cashed 3 days after Chicago lockbox received our AOS documentation (mailed on 15 July - received 16 July - cashed 19 July - NOA1 date 18 July). However, I agree that this is the exception rather than the rule.

Uh, I would say average is 6-10 days? But really... it can take up to a month. So there is no point in counting the days. You have committed to AOS, so sit back and relax, because you can't do anything about it.

The process is opaque and full of waiting, but that's how it is.

It doesn't matter now that her B2 is expiring.
