So I got the call back.... The immigration officer was very nice. She said our file was still at the National Benefits Center. She said we had nothing to be worried about, that we had fulfilled our part in getting married within 3 months of my wife entering the United States. She said we could use our AP to travel while we wait with no restrictions. She explained how to renew my wife's work and travel permit and how we are not the only ones in line waiting for the green card, and admitted to the USCIS' mistake of estimating a 6 month wait. She explained that when we got the NPIW letter USCIS expected only a 6 month wait but that they turned out to be wrong. She said in all reality the wait is about a year. She told us several times not to worry that everything is fine that they are just backlogged.

I said it before and I'll say it again: This continues to illustrate the arbitrary and stupid manner in which the fools at USCIS operate.

It doesn't surprise me, but she did not and will not answer: 1). Why the dribbles and drips from the NPWI are so haphazard? They make no sense. Who's making these decisions of when to let our cases out of their purgatory in the bowels of USCIS in Lee's Summit, MO. Fairness is not in the USCIS lexicon. 2). Why don't field office processing times pertain to NPWI cases? 3). Why do K-1/K-3's who get interviewed, mainly because there are questions of legitimacy of marrige and/or documents, go to the front of the line and get GC's immediately. Why don't they get reinserted into the pile with ours and ferment like we do? (We all know it's all about the numbers and making them look good...don't those numbers look so good...they don't mean anything, but they look sooo good...).

Yup, I guess quite a few of us still waiting. Good thing I have an insane job that keeps me busy from morning till night!

You know what's the problem? We will all get our green cards and eventually citizenship one day (before 2025 hopefully) regardless, we will all forget about these days and won't take serious steps to help the future "US" the NPIW people. This will be our country and our pride we have to find a way to fix this problem in the future. But for now it seems like we can't do anything else but wait WAIT wait WAIT wait... Did I say wait what!??

if it was true, some documents need to be update such as the medical form and 2015 poverty guidelines in I-864P which will use in March.

My question is:

Do we need to update these documents due to the USCIS delay? If we need to update the information, how to make these update document link to our case?

From what we've seen with most cases they aren't asking people to update anything, there has been the odd case but it's tipping more towards us not needing new medicals etc.

I requested assistance from our Congressman the other day about my I485 which has been pending for almost 4 months now. Just today while Im taking lunch I receive an email from the Congressman's office regarding USCIS reply on my I485 and here it goes:

From USCIS National Benefits Center Congressional Unit:

Good morning Andrew,

A review of our systems shows Case MSC14917******, A# A2061*******, DOB 11/*******, Form I-485, filed by Mun************* was received on 9/24/14. This case has been identified as a possible interview waiver case and is currently being held at the NBC pending a field office review. The interview waiver cases are being shipped to the local USCIS field offices based on field office capacity. At this time the processing time is approximately 9-12 months.

I am praying and hoping that it will not take that long but I wouldn't be surprised anymore at least now I will just have to wait. To be in this predicament is really not easy and has been very depressing. According to our congressman's office staff applicants who didn't receive RFE's are best candidate for interview waivers as they met the criteria set forth by USCIS. If only I knew this is the case I could have not complete the documents needed so Il get an RFE...there could have been a possibility that my GC is already okay by now.

But I just wonder....since my case in interview waiver...am I qualified to get an I-551 stamp on my passport? I-551 is a temporary greencard.

Sometimes CBP does give her a hard time and I mentioned this to the IO and she said if your wife has done nothing illegal or is not bringing anything illegal back to the US there is no need to worry, CBP is only doing their job and she said to continue using AP as many times as needed while she waits for GC. So what if it's a few more months of waiting, we're more than halfway there. Patience is a virtue.

Sometimes CBP does give her a hard time and I mentioned this to the IO and she said if your wife has done nothing illegal or is not bringing anything illegal back to the US there is no need to worry, CBP is only doing their job and she said to continue using AP as many times as needed while she waits for GC. So what if it's a few more months of waiting, we're more than halfway there. Patience is a virtue.

While I agree that patience is a virtue and it's often not worth getting too deep in frustration over individual cases, I think the more people that push back against USCIS and escalate their issues, the better. Their processing goal for I-485s is 4 months, and this is nowhere near being met in many cases. USCIS has a commitment to process cases in a timely fashion and, again, this is something that is just not happening for large numbers of people.

Along with a lack of capacity, the arbitrary manner in which cases are adjudicated results in vastly different service levels for different filers, all of whom have invested a lot of money and energy. Through no fault of my own, other people who filed on the same date as me, and paid the exact same sum of money as me, may be granted permanent residence months or even a year or more ahead of me. That's not an isolated incident, it's routine, and the implications are very real. These people can apply for citizenship much earlier, access federal student aid, hold federal government jobs, buy property with much fewer restrictions, the list goes on. No matter how much you can do without a green card, not having one is a hindrance.

There's always going to be cases that require extra processing or that get held up at certain points, and that's fine. But instead, what we have now is wide-ranging delays across the board, without any guidance on realistic processing times, without any ability to access accurate information and without any promise that the situation will be resolved.

I personally am not all that fussed about a longer wait, but I absolutely understand anyone that is and I applaud them for their efforts in trying to get answers or resolutions that could benefit all of us.
