After 2 years of being married you automatically recieve 10 year GC

And a interview isn't required to recieve a 10 year card

OK this is what I am not getting to remove conditions you apply for ROC, if approved you then get your 10 year GC, but I am sure with ROC you have to have an interview and they go through everything that proves you are and have been together for the past 2 years or with their slow process it will be 3 by the time any of us get's to that stage!! So please enlighten me, do we not have an interview with ROC and if so isn't that when we receive a yay or nay for our 10 year GC? Totally confused now!

If I am not mistaken, I think Enorman did not have a timeline set up so it's hard to identify when he got married. NPIW are more common for K1 to AOS applicants. Maybe they got married within 3 months of entering country and waited a very long time to apply for AOS and they passed the 2 years of marriage. Someone correct me if they have information about this please. I have seen posts in the past about receiving 10 year GC when they were supposed to receive 2 year GC. Never saw anything about them calling in to let USCIS know of error. I highly doubt they are making up for all the time they have made us wait.

Now this is what I don't get I thought ROC is for lifting conditions and to receive your 10 year GC and that this is when the evidence at interview will be required? I am lost!

Shell, as far as I understand the process, you are given Conditional Permanent Resident status if your case is adjudicated before the two year anniversary of your marriage. Conditional Permanent Residents (2yr GC holders) have to remove their conditions via ROC two'ish years after they are approved.

If you have been married for more than two years when the case is adjudicated, you immediately get Permanent Resident status and get a 10 year GC.

It sounds like that's what happened in this case. The immediate issue of year 10 green cards is more common to those filing a CR-1 visa e.g. those residents marrying abroad and returning to the US with their spouses.

I hope that made sense.

Interview is required for Removal of Conditions. I have been reading online that certain situations might qualify for NPIW for ROC. Can you imagine another NPIW for ROC after this? I hope I am mistaken. Please correct me if I'm wrong.

I thought that most interviews were waived for ROC, but PLEASE can we not go there. I can't bare it! LOL

OMG I can't bare another NPIW either. If that were the case it looks like if you get the ROC application in on time the Conditional Resident status is extended by 12 months to allow for processing, etc. I smell another NPIW..... Smells like poo

All I know is that you received a Conditional Green Card after the K-1 visa and it is good for two years. At the end of two years, you have an Interview (for ROC) to show proof that you are still together, THEN you get the 10 yr. I know they issue 10 year green cards for other visas and reasons but not for K-1.

Maybe I am wrong and you can receive a 10Yr green card under the K-1 if you have been married for more than two years when they issue the green card. I thought that Nlherman said at one time that his arttorney said that you will always get a 2yr for K-1 no matter what.

Don't blame your attorney just yet, nobody knows what's in the mind of people working in USCIS, plus mistakes can also happen. Ohh a 10 year old GC would be such a good present right now.

Btw, a friend of mine also arrived on K1 visa, received NPIW letter but then her Green card arrived a week after she got the letter. No reasonable explanation for that, husband not in the military. This proves your point, nlhernan, that there is one big mess in USCIS and it's so unfair

It is one big mess, would be easier if they just started all over again, trained staff to give one answer, not several different ones to us, if we are confused imagine how confused they are and how can a business, as it is a business actually run that way?

After 3 years of GC you can apply for citizenship, so even if ROC took over a year you could I assume apply for citizenship even while ROC is still in process...

It is one big mess, would be easier if they just started all over again, trained staff to give one answer, not several different ones to us, if we are confused imagine how confused they are and how can a business, as it is a business actually run that way?

If a 10yr GC is possible after 2 yrs marriage, as it apparently true in my research though nothing on USCIS site to my reading; then you know they could hold us out to 1 yr 364 days just to screw us...

After 3 years of GC you can apply for citizenship, so even if ROC took over a year you could I assume apply for citizenship even while ROC is still in process...

Unfortunately I don't think that is the way it works. Waiting for AOS for a year adds another year to our journey, they take our residency from our conditional GC, not from the date we got married! I hope someone tells me I am wrong!
