Sorry Shell I missed your reply, I can't even begin to imagine how your situation must be, with your son over there and you and your new husband here, USCIS clearly doesn't give a damn though

No problem, I guess my son can ask for a transfer from work as he works for an American company in England, I think I told you he is a computer programmer and now a trainer, he has climbed the ladder pretty quickly with his exceptional gift for it. He taught himself to programme when he was a mere 13 years of age from a book, he also taught himself A Level maths too. Ironic he landed a job with an American company that saw his raw talent. I keep trying to encourage him to apply for Google in Pittsburgh. I just want my whole family to be together so I can finally feel complete! Not much to ask for is it? :(

Yeah silly me, that's what it says on my letter, in a timely and orderly manner!!

Perhaps it's this American English/ versus English/English thing, we decipher it all wrong, you know like the saying "Bobs your uncle", but he really isn't!!!!

OK time to log out for a few hours, hitting the road to Philly. I hope by the time I get there and I log into my laptop I see some approvals. Perhaps they are waiting for St Patricks Day so we can all celebrate with a pint of Guinness? There we go Natonstan, they want you to celebrate the Irish way!! Any way catch up with you all later. Good luck!!

Yep shame the USCIS doesn't promote them to first in queue for GC!

I just spoke to a tier 2 officer and I was shocked with the response provided by her...Basically, She told me that if you have received NPIW then your case can actually take up to 2 years and I should renew my EAD/AP card to maintain my legal status in this country and there is nothing they can do because it is pending with USCIS. Also, she mentioned that every case is different and there is nothing they can do if some cases are approved earlier than yours even if your case is 2 year old...I don't buy it but oh well....

She also told me that it doesn't matter which field office it is in and USCIS will take a joint action bases on that and somebody is looking in the case and they are verifying background information. I have been told by a Tier 2 officer 2 weeks earlier than on Feb 9, somebody was looking into my case and they received the information they have been waiting for my case but today i was told that there is nothing like that and nobody was waiting on anything. Talk about confusion among themselves!!!

I am just going to give up on this process and just hope that before I die, my case will be approved by some miracle.

That is what the ombudsman is for! 2 years, yeah right, you would be entitled to ROC by then. Someone there also is obviously telling porkie pies, did you get names? I think you need to get hold of a congress person and see what they think about what you were told, then contact the ombudsman and repeat to them what you have just been told. Like we've all said lately they don't care and it seems they enjoy the power that they have to say yay or nay! Shameful!

I don't think that whether you take names or not, it doesn't matter. From what I've read and observed that they are not accountable to anyone whether its Congressman or Senator...

I thought that Government offices in India were bad but now I think its the same. I will give them the credit that at least they treat everyone same when it comes to K1 AOS, they don't give a ####!!!!

And before I pack up my laptop, how can you be out of status if you don't renew your EAD/AP card? I thought the EAD card was for employment and the AP for travel? I thought applying for AOS which you have done and which is still pending kept you in status? Any one else have a theory on this one? 2 years? Not once have I heard that it takes up to 2 years. I have however heard someone waiting that long and then taking the USCIS to court because of it!

Sounds like someone just wanted to get you off the phone and make sure you didn't ring again for a while. If 1 tier 2 says one thing and another an entirely different thing, then someone is making it up as they go along! And they can be sued for delaying processes, they aren't above the law. http://www.hackinglawpractice.com/practice_areas/missouri-immigration-delay-lawyer-uscis-lawsuit-over-long-delays.cfm

I don't know, beats me!!! I have to say that she was the worst Tier 2, i ever spoke till the date! The way conversation started, I had a feeling that she is not going to be any help because I could sense that she doesn't give a damn what my NOA1 date was as she had a standard set of reply for everything I asked.

Well when I spoke to Tier 2 on March 3 about the lost paperwork she told me that they had not received it and asked if our checked was cashed with renewal. I told her there was not a fee. She said that there is a few with renewal but not the original filing. I said NO, according to the USCIS website there is no renewal filing fee with !-485 filing. She finally agreed. Then I got a text on March 4 saying that Chicago received the renewal on March 2, but Tier 2 told on me March 3rd that they had not received it yet. Sooooo none of them seem to know what they are talking about.
