Notice of Potential Interview Waiver Case

We have now officially passed the one year mark since my husband's AOS NOA1 receipt date (March 5, 2014) and we have yet to receive his greencard. I have filed a service request today to celebrate this wonderful occasion (sarcasm intended)! :bonk:

If you have not done a Congressional inquiry, it is time to do so. Unless your Representative is Joe Wilson, bypass him/her and go to one of your Senators, the one you like or your spouse voted for or the one you can minimally tolerate. Our Senate office immigration staffer (minimally tolerate) got a message from USCIS saying a decision would be made 9 - 12 months from receipt. They said to is that at point they would raise the roof for us. Someone needs to raise the roof for you...

I agree with Derwood the news is good but disgusting as well. Why? It takes time to move a file to a field office, even across town from the Supermax Penitentiary at Lee's Molehill to the KC Office. Then and only then do you start the next wait there - 60 days. We have the same NOA. Our file was requested by the NYC office on 1/23 and it didn't arrive until 2/4 and we still wait. And unfortunately it sounds like you might wait longer than us. We predicted 3/28, but I believe that is optimistic. We will see our 1 year "anniversary" and we will NOT celebrate. #USCISyoustink

You know since joining this thread I have tried to be SO positive. I've tried to see the good in each letter or communication. I've believed the USCIS would try to play catch up and sort out this stinking mess, but I've now resigned myself to the fact that a years wait is now their "norm" and I doubt they could even play catch up with their own shadows.

Nor can we blame it on DACA, the simple fact is that they don't care about AOS cases, once we have our EAD cards then we are taken care off and the GC is irrelevant. They don't seem to think about people who need a GC to get certain positions, why bother they can be expedited at their leisure nor do they don't care about families being kept apart and the fact it just adds another year to that wait if we wanted to sponsor any family member. They don't seem to realise that when we fell in love we made many sacrifices, leaving our loved ones behind, trying our hardest to adjust to life here and coming across many obstacles through immigration that simply shouldn't be there. Yep USCIS, you suck!

I would press the like button to that sentiment, but they don't have one! All I can do is second that emotion!

still waiting too... didn't count the days but I think it's almost the end of this journey ^^

But I still don't understand why it take almost 2 years (visa K-1 process + AOS process) to be welcomed with the official path when I see people come with ESTA, get married and receive the welcome letter after a few month ... I'm happy for them but really don't understand...

Thank you both for your sentiments! I am convinced that USCIS really hates us since we have had such a rough time with both processes! 2 years waiting for K1 (including 2 AP rounds) and now a year waiting for greencard. I can't wait for this to be over and not have to worry about anything until ROC. Maybe by the time we apply for that, USCIS will forget that they hate us and we will finally have at least one easy and smooth process!

Because they get rewarded for doing it the illegal way. When someone comes over on an ESTA and marries they forego the wait for K1 and the expense, then because there is a "red flag" when they file for AOS, they get an interview and then get their GC quickly.

However the people who file for a K1 have a long separation from their intended spouse, go through an expensive medical, security checks, expensive bills then pay for AOS have to wait patiently for a year and then be happy for the people who overtook them. It's not the way it should be but it is the way it is I guess.

No, DACA is not the direct cause of our wait per se, but as the NY Times article stated several weeks back, there is a concerted effort by someone or some agenda that has obstructed the hiring of new IO with approval power to solve the back log that they themselves say they need God knows they have the money from our fees... #USCISadministrationyousuckmost

Good morning you all!

Shell 20, when you re-entered US with the AP did you need to provide any other documents beside the AP card and your passport? People keep telling me it is risky.

My husband told me he did research and the K-1 visa was the best way to go.....if only I knew that it could mean endless waiting. >.<

Your timelines are freaking me out, can't believe some of you have been waiting over a year! Ridiculous!

Yes they do have our money and if it was a restaurant with our money and we got no food, we would complain and if the restaurant had good customer service then they would rectify the problem, but alas USCIS don't seem to want too. To be honest I think I am getting past caring, not about you guys, but whether the USCIS can get their act together, it's increasingly doubtful!

You CANNOT use the K1 visa, the K1 visa is one only entry and it becomes extinct once you have used it. You are in AOS, have you received your EAD/AP card? The AP is what you have to come and go with!! What I did was I took a copy of our marriage certificate and the letter to acknowledge I had filed for AOS and was currently waiting for my GC. I also obviously took my EAD/AP card. That is all you need, they didn't look at my marriage cert or my 1-485 noa 1. It is not risky if you have your AP card that is the whole purpose of it!

I'm reading all your posts about USCIS and I agree with you Shell I'm in the "I don't care anymore" mindset, we've all waited months and months and it's now turning to a year or more for some of us, if someone would've told me back in April 2014 that we'd all still be here waiting for our Green Cards to come through I'd laugh, it's a sick joke and you're right they don't care one bit, they don't even give us one thought, just keep doing their drip drip system while we file SR after SR and just get a generic response telling us we have to wait..it's really really sickening
