Yawn.... Could the USCIS, please, please wake me up with some approvals, some action today. Im bored. Thank you in advance!

I would like to make this same request, I wonder why it's always in the afternoon that we start seeing approvals, do they sit there all morning staring at the pile?

My congressman's office forwarded the latest reply from USCIS (dated today) which indicated nothing new. My case is still at the NBC:

A review of our systems shows Case MSC1490924xxx, Form I-485, Axxx, filed by Mr. xxx xxx has been identified as a possible interview waiver case and is still currently held at the NBC pending a field office review. The interview waiver cases are being shipped to the USCIS field offices based on field office capacity. At this time the processing time is approximately 9-12 months.

The rep said to contact her again if there's no movement in 6 weeks, which will be when this supposed 12 months is up.

Excuse me ," At this time the processing time is approximately 9-12 months." Do you know when it began to count ? 9-12 since NOA date ? or since the interview waiver letter ?

i remember somebody said they got their GC approved very soon after they received the same response with yours .I think you will be getting it in a week :idea: my response had never been like this ,it basically said same thing with the waiver letter

Well first they have their wheaties as someone pointed out the other day. Lol Then it has to be a staff meeting, probably saying look guys, stop using field office ref numbers, the customers have sussed that one out. Just put MSC on everything now even if it has gone out to the field office, we need to make sure that they get even more confused.

Oh Woah...I got the printed email from my congresswoman's office (from USCIS) dated 2/18/2015. Exactly the same as yours! just my name and case # are different (duh)

I didn't receive a PIW letter though~

So, I showed my lawyer the letter from the congresswoman...And my lawyer said "They do not know what they are talking about. 100% you need interview. no way of waiver as it is the law. disregard the letter."

And I called again today to USCIS, got transferred to higher level customer service lady (she called me back) just now. She said there's no record that my case is PIW, and no record shows that my case is in NYC field office (which my lawyer said it is).

The higher level customer service lady did mention that since the email is from the ISO of the Congressional Unit, the information might be more accurate than whatever in the USCIS customer service computer system...

But the higher level customer service lady said that my case is definitely not in NYC field office...

I JUST WANT TO KNOW WHAT IS GOING ON... THESE PEOPLE ARE DRIVING ME CRAZY.

An NPIW letter is pretty generic, but this case has left the cobwebs of the NBC... So approval is in the air!

To reiterate you can be approved without an interview. However, you still might get an interview with the waiver letter it is NOT unheard off.

I doubt the Congressional Unit have their own computer to see that information, however they might have contacts higher up in USCIS. If they told you your case has not left and it is an NPIW case then I would go with that. Also yes, Tier 1 are the people who pick up the phones and Tier 2, ie a supervisor are the persons who have more knowledge and access to information.

Time to get a new lawyer because he (or she) is clueless. As you can see on this forum, K-1 AOS as one of the eligible classes can be waived for an interview and receive a GC without one.

Sounds like your lawyer should be one of the 200 lawyers on the bottom of the ocean...

BTW, my congressman's office told us that USCIS is just as elusive and evasive with them as they are with us. Why? Because they can...

I didn't receive the PIW letter. But Congressional Unit ISO said my case is a PIW case.

The I-485 interview can be waived in the following situations:

  • Applications for minor children and stepchildren of a US citizen parent that are filed with supporting documents that are original or certified copies
  • Applications for parents of a US citizen that are filed with supporting documents that are original or certified copies
  • Applications for fiancés of a US citizen and for children of those fiancés
  • Cuban natives and/or citizens applying under the November 2, 1966 Act

I'm non of above either...
