Yes. You can get an RFE at anytime before the green card is approved. They can even ask for additional evidence at the interview that you would need to submit before an approval could take place.

Got a call from Memphis office yesterday asking for another copy of our Marriage Certificate. Instead of the usual RFE letter, they just called and asked us to fax it to them. Faxed it this morning around 10 and got AOS approved this afternoon! December 2013 filers, got interview waiver letter in March and got approved today. Woohoo!!!

I receive the waiver letter last july 11

The last update of local USCIS says that in may 31 was doing the files of jan 13 2014

So I hope can get an update soon

Is anyone aware of a way to track the average time of the "interview waiver" cases? Either within VJ, or perhaps USCIS?

Perhaps it could be added as an option on the timeline - the date of the letter - so a trend/stats chart/table could be set up? It seems to be happening to a lot of people, so it may give a bit of hope :)

Hello, guys.

Any news for those who filed the documents in January? it is so time consuming. I have a question, please help me. I need to go to Ukraine for about 3 months, it's a family emergency, I have AP but still waiting for GC. Is it ok to stay that long in my native country?

I am a January filer and still waiting. I check my online status everyday hoping to see an approval. April and May filers are getting their green cards, so unfair!

I filed in September 2013 and still waiting, it is indeed unfair to see people who filed after us being approved!

Just wanted to help with anyone who is trying to work out an average wait between the interview waiver letter and a decision. I received the letter in mid-February and saw my green card was in production yesterday, so it's been 5 months for me. I filed in October but had an RFE in November which I couldn't deal with until January so my timeline won't represent the norm but thought I'd try and help out with the numbers anyway :)

Edit: Because of the RFE, my case was being processed at the National Benefits Center, not my local field office. Thought that's important to note as you can't get a 'current process time' for the NBC, annoyingly.

AOS Timeline

7th Oct 2013 - Mailed I-485 package

15th Oct 2013 - NOA1 hard copy

4th Nov 2013 - RFE

8th Nov 2013 - Biometrics

13th Jan 2014 - USCIS confirmed receipt of returned RFE evidence

27th Jan 2014 - Received EAD card

Feb 2014 - Received potential interview waiver letter

19th July 2014 - AOS approved, green card in production :D
