Hello

I recently married, and applied for green card. I thought I submitted everything. However, I have received RFE.

According to the letter, it says

Submit a completed and signed Form I-864 Affidavit of Support for the petitioner/sponsor listed on Form I-130 or Form I129F. Even if a joint sponsor will be used the petitioner/sponsor must submit Form I-864. (The Form I-134 is not acceptable to use for Adjustment of Status.) Also provide copies of the petitioner/sponsor's most recent Federal Income tax returns.

If you have submitted form I-864, the vision you submitted is no longer accepted. You must submit Form I-864 with a revision date of 3/22/13.

All pages of Form I-864 must be present and of the same revision date.

After I received this letter, I found my application form I-864 I sent was old version. However, I sent my husband's 3 months pay stubs, 2012 and 2011 tax reports, evidence of military service, and passport identity page. We could not find 2010 tax report. Do I really have to send 3 years of tax reports? Even though this year annual income meets the poverty guideline, last year was not. In that case, do we still have to send evidence of personal assets such as stock and saving account? If yes, do I have to get last year bank statement or current bank statement?

thanks for reading

You do not have send all 3 years worth, but you need to list the total income from the last 3 years. You are only required to send in the most recent year, which is 2012. If you cannot find it, get a free tax transcript from the IRS.

If the current annual income meets the requirement, then no assets need to be listed.
