Hi, new to the forum and to the visa application process. My fiancee and I have been together for nearly 5 years now. We met online but met in person for the first time in March 2009 when she came over here to visit for 3 weeks. I've been over to SoCal on 3 occasions, each for about 12 weeks. Now, onto the problem. Whilst we have lots of photos, checking back through them and we only have ones with both of us in from her trip here and my first trip there (Oct 2009-Jan 2010). We don't have any in the 2-year period the step-by-step says to send. Also, due to finances and poor health on my part we haven't seen each other since Jan 2012 (she is coming over here in Nov, yay!). Basically, will these issue scupper our chances of applying now?

Welcome to VJ! If you were last together Jan 2012 then you're good with the 2-year requirement. I just hope you kept all the passport stubs, receipts etc. to prove that you have been together within 2 years from filing. If you don't feel comfortable that you have enough proof, then it might be best to wait 'till November so you can gather more evidences. Good luck with your visa journey!

Please review the Form I-129F instructions, Page 5, #7, and see if your current circumstances meet with the requirements of the the K-1 visa process. If so, you are good to go. If not, make arrangements to meet soon and save all manner of evidence as described in the instructions and VJ Guides.

Hi There,

I assume that you have exchanged a number of emails / text messages / etc during the course of your relationship? Also, if you have sent / received any Birthday / Christmas cards etc. Essentially a paper trail between the two of you.

All of this can be submitted as supporting evidence of your relationship.

Even though I actually was in physical contact with my fiancée for a over a year and a half, we had very few photos (I hate having my photo taken).

The email submissions were accepted with the initial petition and we got through to interview etc without a hitch.

They don't know when the photos were taken. That's why photos are secondary evidence. How do they know if the photo together was your first trip or Jan 2012? Send some photos just so they can see you together. Then come up with passport stamps, etc from Jan 2012. If you made credit card charges in or near her town, that shows you were there. Find a paper trail of you going to SoCal in 2012.

Thanks for the replies. Yes, we have cards (with the important stamps). I have my boarding pass from the return journey on my last trip, although not the outgoing one and have the e-ticket. I did make some debit card purchases and withdrawal of money at ATMs over there. We call each other several times a day so I have phone bills.

Calling each other does not meet the requirement of meeting face to face. Focus on the requirements:

One a USC (US birth certificate)

Free to marry (any divorce decrees from either person)

Intend to marry (a statement from each)

Met in person in the last 2 years (your paper trail of trip in 2012, as much as you can find. Don't forget passport stamps of entry)

A few picture are nice. Easy on the extra fluff like 5000 phone calls, love letters, etc. Don't put so much of that in, that USCIS can't find the actual things they need to approve.

Cheers, Nich-Nick. We have all that and have decided to wait to file until after her trip out here in November, so we have the two-year period bookended with trips as well as giving us the opportunity to have more photos of us together.
