We just get married :)..I'm USC and my husband is not -he overstayed his tourist visa..Can someone point me out how we should start the whole "green card" process for him .He is already here ..is that complicate this process ??? anyway - we are not sure which forms we should use .

You will want to do Adjustment of Status. Overstays of spouses of U.S. citizens are "generally" forgiven.

02/20/07 - CASE COMPLETE!!

04/18/07 - INTERVIEW!!!! - APPROVED!!!!

1/25/07 - approved ...NOA2 via snail mail - 1/29/07

03/16/07 - chose not to return packet 3 to Montreal

Your huband's tourist visa, along with other facts of the situation that you do not mention, may complicate the process of becoming a LPR. Start by having a consultation with an immigration attorney who has experience with these types of cases to discuss the details of his situation and get some advice based on those details.

I haven't started any process yet neither am i married to a US ciitzen but i seriously find it hard to believe that the overstay will be forgiven. Overstaying is a crime but anyways if it's official now that overstayers will be forgiven, then good luck :D

As far as I've heard, overstays of spouses of U.S. citizens are generally forgiven, that's not something new. In addition, I'm pretty sure that a simple overstay is not a crime - it may be grounds for a ban, but that doesn't mean it's a crime.
