why not file 1-130 together with adjustment of status papers since f2a category is current, and she is in the US? the process will be faster if you file in september while f2a is still current.

i am not sure how long it would take for her to get her H1b visa, sorry. someone else might help.

Hi ALL,

I'm a permanent resident of USA and would like to file Green card for my wife who is in USA on H1b Visa (Work Visa).

How long will it take for her to get Green Card, If I file this year? please let me know.

First you have to file I-130 for your wife which will go to USCIS. Once USCIS approves your I130 application then you guys can apply for adjustment of status for her but right now it takes minimum 1 year to get approval from USCIS.

Since the F2A category for September is "current" and your spouse is already in the US (with the valid H1B status), you can file the petition (I-130) and adjustment of status (I-485) concurrently - i.e. send I-130 and I-485 in the same packet to USCIS. She can also apply EAD and AP at the same time, but since H1B visa allows dual-intent, it should be fine for her to continue to work and travel using her current status.

If you want to do that, you must file before September 30 because the priority date is most likely to retrogress in October so you won't be allowed to send I-485 when the visa is no longer available.

8/20/2013 - Delivered to USCIS Chicago lockbox

8/26/2013 - Check cashed

8/29/2013 - Received all four I-797C's by mail

9/3/2013 - Biometric notice received - scheduled for 9/18/13

9/11/2013 - Received email for Request Initial Evidence
