Hi there,

We will be putting our I-751 package in the mail next week, and I have a quick question about the (minimum) 2 sworn affidavits:

Must they be notarized? The template I found on this website has a section for a Notary Seal and signature, etc. but is this absolutely necessary? It might be tricky getting our friends/relatives to a notary before our application has to go in the mail. unsure.png

I know this doesn't directly answer your question but I am sending our packet off tomorrow and we have not included any affidavits. I think that we have enough evidence without them. What else are you sending as evidence?

04/02/2011 - NOA1 hard copy received - priority date 03/30/2011
07/08/2011 - Trevor is now a USC - called USCIS to request upgrade of the petition.
08/02/2011 - NOA2

09/30/2011 - Interview date assigned
11/08/2011 - Interview - approved!!

I think on the USCIS website it says "sworn affidavits". We got our 2 affidavits notarized and we actually had 2 from each person, in case they get lost.rolleyes.gif

This is from USCIS page: "Affidavits sworn to or affirmed by at least 2 people who have known both of you since your conditional residence was granted...." http://www.uscis.gov/files/form/i-751instr.pdf

Thank you everyone for your quick responses! I really appreciate those links. We will try to have them notarized (at least one of them) but from what I'm reading, a lot of people didn't bother. I guess it helps, but it's not a hard and fast rule. Some people didn't even send affidavits at all. They must've had other strong evidence, which unfortunately my husband and I don't really have...

In addition to the affidavits, we will be including joint tax returns from 2011 & 2012, utility and credit card bills showing we reside at the same address (but unfortunately neither of which are joint bills) and a bunch of photos. We haven't really "co-mingled" our finances and the deed to our house is in my husband's name only- he owned it before we were married. This is what I'm nervous about because I know those are the strongest forms of evidence. Oh well, we'll just have to hope it's enough.
