My daughter has a vaild F1 Student visa until August 2015. She also has a valid Visitors B1/B2 visa until 2017. She is taking a year off from her studies, and intends to return home shortly. International Office at University says she has USA to leave within the time frame of one month - if you are not attending classes, they have told her that she must leave within 4 weeks of classes having started for the new semester, which is 25th September.

She is trying to get stuff sold etc, and would like to stay until October 10th. Bearing in mind that her visitors visa is still valid, can she stay until then, or does she have to leave by the said date ?

There are no issues outstanding with her and university. She wants to change her major, and we think she should take a break to really think about what she wants as her career choice.

Any advise is appreciated. Thank you.

She cannot just stay in the US coz she has valid B1/2 on her passport, an individual can enter US only under 1 visa at a time and when she entered last time, she was admitted on her F1.

She might be able to file for change of status, when she does that she would get a new i-94 corresponding to her B1/2.

She should leave within the time the advisor told her. What is most likely a slight difference in dates isn't worth causing future problems. If she has a friend she trusts, she can always leave them a Power of Attorney to finish up any business she has left if she doesn't get done in time.

And, BTW, when she's ready to go back, she will need to apply for a new student visa, since it appears there will be at least a five month gap between her periods of studying.
