I-797C and change of status from F1?

Dear All,

I had filed I-130,I-485 and I-765 concurrently for wife. I have received I797C for all forms. I was wondering, if my wife could change her status from F1. So, that she does not have to maintain her status. Also, she is graduating this december. I don't want her to apply for OPT after her graduation.

What does she need to do change her status from F1? Can she change her status? If someone has done it already, please advise and the things that needs to do to change the status.

08/07/2013: e-mail and text received from USCIS.


08/12/2013: received hard copy.


08/22/2013: received hard copy of biometrics for 09/06/2013.


09/06/2013: Biometrics done


09/11/2013: I-485 status changed to 'testing and Interview"


09/23/2013: Received text and email- EAD in production


09/27/2013: EAD card mailed.


09/30/2013: EAD card received. Still waiting for Interview date.


12/23/2013: Interview scheduled for January 29,2014. Waiting for hard copy.

Since your wife has filed an I-485 then she has already filed to adjust her status.

Since your wife has filed an I-485 then she has already filed to adjust her status.

So, that means she does not have to maintain her F1 status. Please clarify. We have only received I797C so far.

No, she doesn't have to maintain her status, since the I-485 gives her a new period of authorised stay which persists until that application is adjudicated.

She went to college today.she was told to maintain her status until she gets her GC. But she is graduating this december.And we have already applied EAD. Does she has to apply for OPT, if she gets her EAD soon. PLEASE ADVISE

She can choose to maintain her status, but doesn't have to. Her AoS filing places her in a new period of authorised stay which persists until the I-485 is adjudicated. If she chose not to maintain her status then she would not need to apply for OPT.
