Jahan,

Many states may say that in their generalized statement of requirements, and they may even enforce it for a USC, but a non-USC is cannot be required to have a SSN to get a marriage license.

Yodrak

And *many* States require that you and your fiance/e MUST have SSN to be able to obtain a marriage license or you can not get married. SSN can easily take 4+ weeks from arrival so you need to look into this or you may have to reschedule your wedding plans. Find out what is needed for marriage license!

Jahan.

Thanks for the info Yodrak. When we went to get our marriage license here in North Carolina, I (the non-USC) was asked if I had either a SSN or a Taxpayer Identification Number (TIN). I said NO. She said that I *may* be able to sign the affidavit stating I wasnt eligible for SSN. Then she looked at my K-1 visa and phoned the SSA Office there and then. They informed her that I was eligible for a SSN. She then said that since I am eligible for SSN I must produce one!

So from our experience, a non-USC may not be required to have an SSN for a marriage license yet some states *CAN and WILL* enforce it if the non-USC is eligible for it. All depends on the knowledge of people working in these offices.

Jahan,

Agreed, it all depends on the person. If the person you first speak with is ill-informed (such people do not run into K1s everyday, it's something out of the ordinary for them) try to speak with someone else or a supervisor.

Immigration law gives a K1 90 days to get married, local government clerks cannot hold them 'hostage' for a SS card.
