Taya Kyle is the widow of slain American Sniper author Chris Kyle, the executor of her husband’s estate and the defendant in a defamation suit filed by wrestler-turned-governor Jesse Ventura stemming from two pages in the Navy SEAL’s autobiography. That trial, about a fight Ventura says never happened, has been set for May 1, 2014, and is set to take place in Minnesota. Taya Kyle last month asked a federal judge to move it to Dallas, insisting that the “responsibilities of [being] a single parent while also managing the affairs of her late husband, who was tragically murdered in February” make a protracted trial far from home too difficult.

But Ventura and his attorneys now insist that moving the trial would be unfair to the former governor of Minnesota.

“The motion should be denied because, despite any alleged inconveniences the Estate may face in connection with a Minnesota trial, moving this case to the Northern District of Texas would serve only to shift the inconvenience to Governor Ventura, and to make available a jury pool that would likely be biased in favor of ‘hometown hero’ Chris Kyle,” says the motion, which you can read in full below.

In their filings, Ventura’s attorneys say Taya Kyle and her lawyers “never expected or intended” to convince a judge that moving the trial to Dallas was “appropriate” or necessary. Instead, they insist, it was all just a public relations ploy intended to “publicly disparage Governor Ventura and influence the court of public opinion.”

As a matter of fact, they insist, last month’s filing was written “more for the media than for this Court.” And, they say, Taya Kyle was away from home for two weeks in August as part of the Patriot Tour that took her from Houston to Minnesota to Pensacola.

“The Estate’s lawyers have again littered their brief with unnecessarily vitriolic comments and personal attacks against Governor Ventura regarding a claimed lack of concern he has shown for the families of
deceased veterans by continuing this lawsuit,” says the filing. It goes on to insist that Taya Kyle has tried to portray Ventura as “as doggedly pursuing his claim against a ‘widow’” while leaving out the fact the “publisher’s insurance company has been footing the bill for defense costs, and will likely
end up paying for any damages awarded.”

Moreover, Ventura doesn’t want to step foot in Dallas, where Kyle, says the filing, would have home-field advantage.

“It also cannot go without comment here that, by granting the Estate’s motion, trial would take place in Texas,” says the filing, “where Chris Kyle is revered as a hero.”
