I-130 --- 3 years tax returns

USCIS will need 3 years of tax return but I only have income for tax return of 2011 and 2012. I don't have income for 2010

Will they need the current year 2013 tax return? because expiration date to file tax is April 15th in 2014

I do have assets to cover and I know it shouldn't be a problem.

Sorry to confuse you, but is it okay to not include the current year 2013?

For the I-864? You only need most recent tax return - the previous 3 years are optional evidence. Most recent tax return year they'll be expecting to see is 2012's return.

What's the reason for not having a 2010 tax return? 2009? Part 6 asks for the previous 3 years returns gross income values (2011, 2010 and 2009), but says below that you can optionally attach the returns for those years.

As you say - 2013's tax returns are not due until next year, because 2013 is not over yet. It's not possible to submit a tax return for 2013 yet.

If you did not file a tax return for one of the 3 previous years (2012, 2011, or 2010) you need to make sure you note that on the I-864 and send a letter stating why you didn't file a return.

Thanks everyone, I'm expecting USCIS to request I-864 in March 2014.

Does tax return 2012 counts as the most recent one? since April 15th, 2014 is the deadline for 2013 and not everyone have their tax return by then.

I AM PRETTY SURE-- that would be your "option", first of all IF you could get your 2013 return prepared BEFORE you are asked for the Affidavit of Support, BUT it would not be required for any petition made BEFORE 4/15/13.

I am in a similar position and understand your worry- I do NOT want to be in a position to ask for a co- sponsor and qualify but like your affidavit there is room for interpretation.

To elaborate- they are looking FIRST for your current ability to provide support and secondly the stability of your income- and obviously the last three years represent the stability, I BELIEVE a well written cover letter and documentation explaining your situation and the ability to demonstrate the ability to support SHOULD be enough- at least I am counting on that.

If you are in the visa process (as your information indicates), then USCIS will not be requesting your tax information, it will be the NVC that requests the information. A Consular Official at the Embassy or Consulate has the final say on whether or not the I-864 is accepted or rejected.
