Hey guys!!

I'm trying to stay ahead of the game and although I have not received my NOA2 in the mail (they are taking longer than I expected but I know it's approved) I am trying to get all of the things on my end together.. With that said I am looking at the I-134 form. I am petrified that they will say I can't support my fiance. I make enough to support 8 people according to the chart for poverty guidelines and we will be a family of 4. My concern is that I don't have money in the bank and only have 2 years of tax returns because I used to work off the books before and for about 3 yrs I was on public assistance.

However I have been at my current workplace for a year and 10 months, I have a good income, I haven't been on public assistance for 2 yrs, I have the last 2 yrs tax returns, I have a car, I have an apartment.

Please give me your honest opinions!!! Do you guys think that will hinder this visa journey??? Will I have to have a co-sponser??? I don't really have people I can ask, I'm nervous I need him here with me!

Hmm you know what? My question is do you count your fiance as a member for poverty levels before they even get there? Or only count who is currently in the household? Those questions would depend on how you look at the poverty level guidelines.

I think you are supposed to have 3 yrs tax returns.

I dont have money in bank either. I support two teenagers lol

8/02/17 Biometrics appointment DONE

3/05/18 case moved to local office

8/25/18 Extension letter (18 months)

9/29/18 service request submitted

10/06/18 response to service request

10/11/18  approved. No RFE, no interview

10/16/18  approval letter received in the mail

10/19/18 greencard received

I hope so lol. I have two kids who I partially support as I get court ordered child support. If they don't count him in my income it would be even better because as I said my income goes way over the limit. I guess my biggest concern right now is that I only have 2 yrs tax returns.

You should be fine. If you really are worried, just get a co-sponsor. However, you did say you are way above the poverty line so your ok. The I-134 is rarely checked at this level. I can't recall anyone in the last several years being asked for the form during the interview process (amongst those who have interviews in Santo Domingo).

In the future, you will need to complete the I-864 (much more important) form that will legally tie you to your fiance/future husband. Meaning that you have agreed to take care of him financially while he is in the country (even after divorce). It is unlawful for him to be a burden of the state (he cannot become a public charge). Not to scare you, but this form is much more important. For now you should be fine. good.gif

Once again thank you MrTee12 you are very knowledgeable!! If my calculations are correct and everything goes as panned I will have the 3rd years taxes before it is required.

My question is...how did you know to send in your tax forms? I mean, I guess it's a bit obvious but on all the guides, nowhere does it say what "supporting evidence" to send in with the I-134.

Hello hjm0812,

I've read the instrustions thoroughly on the USCIS page and it states that you have to prove your fiance will not be a public charge.. It does mention tax forms on there but not as my fiance thought. It sates it under if your self employed, then you would need to present your last tax return.
