Hey,

So my concurrent I-130/I-485/I-765/I-131 application arrived in Chicago on Aug 28th (Thanks to the people on here who helped me with that by the way!). Good news is I just received email confirmation this morning that my application has been received and routed to the NBC.

Since the NBC only do the I-131 and I-765, does that mean the other part of my application was sent to a different service center? They gave me 4 case numbers to check the status of the 4 main applications and all apart from the I-485 hold the status "Initial Review".

So would you say that I've received my NOA1 then? Also, In my previous thread I had mentioned I would like to leave my current job (O-1 status) asap. Do you think now it would be safe to do so? Or should I wait to receive the I-797 receipt notice in the mail first?

Thanks!

Paul

You can leave your job now if you want but you won't be able to work again until you have your EAD. Your I-485 is at NBC and eventually will be passed along to your local office for your interview.

Yep, I totally understand not being able to work until I have my EAD. I was planning on taking time off to work on some personal projects anyway, that's why I'm considering giving my notice in the next couple of weeks. Thanks!

*** Thread moved from main "AOS from WS&T Visas" forum to the Case Progress subforum. ***

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Hey guys,

Before I pull the trigger and let my employer know that I'm quitting, I was thinking of using a service like visapro(email consultation) to get an official answer from an immigration lawyer. I would explain my situation and ask wether or not it's safe for me to leave my job while my case is being processed. I have no intentions to work until I've received my EAD. I just don't want to run into any trouble or get deported.

I trust your word, but I just want to be 100% sure. It's actually my wife who's more worried about it :)

So, I guess what I'm asking is... Do you think it's worth paying $25 to send an email over to VisaPro and ask? Are they credible? Would you recommend someone else?

Thanks!

You are now in a NEW period of authorized stay with permission to wait in the US until your I-485 is adjudicated. I think if you search you will find lots of corroboration and examples of this same question being asked on many different sites.

What does your wife think will happen? A lot of people file AOS when they have overstayed, etc. It's not penalized for spouses of USCs. Now that you have stated your intention to immigrate, your O-1 is dead anyway. You can keep working on it, but you wouldn't be able to get a new one (status remains, visa does not).

Never heard of visapro.
