Hello, I tried to post some questions last night but I think i must have "clacked" instead of "clinking" or something. The post got " lost" somewhere. It is okay because I was having a difficult time explaining what I wanted to ask.

This is sort what I looking for last night except I was try to look for a guide for a K-3 filing. I might me getting lost in the terminology.

I am trying to help my friend file the appropriate paperwork to bring his new family to the US. He married a woman two months ago. She lives in China and has 2 teenage children. I was thinking that we should file K3/K4 paperwork. Reading some of the post and info on VJ I am getting a little confused. People talk about the K3 process. Some seem to talk about filing it but then others seem to say that is not the way to do it. I am try to understand the difference between K3, Ir-1, Cr-1, I130 and I129. The link posted by Blueberry Pancake would work if it was for a K-3. I think that I might be missing the point. Can anyone help me see things a little things more clearer? I would appreciate any help. Thanks. Danny Boy

The I-129f for K3 is filed for *after* the I-130 for CR/IR-1 visa, as it needs the receipt for that (NOA1 for I-130) in the submission.

Short answer: The K-3 is essentially obsolete, and the CR-1 visa is superior regardless. :)

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

If you want to file for the K3 path, then you wait until you have the receipt from the I-130 petition and then file the I-129F with a copy of the NOA1 from the I-130.

They remain petitions until they arrive at the NVC. If the I-129F arrives at the same time or after the I-130, it is administratively closed by the NVC and you continue on the IR1/CR1 visa path. You have no choice. If it arrives before the I-130 you can potentially proceed with a K3 visa. If there is an approved I-130, even if the I-129F reaches the NVC first, the consulate or embassy may close the I-129F themselves.

For helping your friend -

tell him he must file an I-130 on each human.

3 humans? 3 I-130s. 3 fees of 420 each.

Also tell your friend that there's a 99.8 percent probability, that any K-3/4 chasing will die a horrible death at the National Visa Center, and filing that subsequent I-129F to chase a K-3/4 is really a waste of time.

Ultimately, he's chasing CR-1 visa for his wife and TWO CR-2 visas on the children, with DOC INTAKE for the visa applications at the National Visa center, after the I-130s are approved with USCIS.

China is a different beast, so although you are 'helping your friend' - how aware are you with US Embassy Guangzhou / Immigrant Visa Unit processing and adjudication ?

Thank you for the added posts. I went to the links that were posted. And I also went to some of the Guides. I read them several times. The K-3 does not seem to be the way to go. I am not 100% clear why but I will follow your advice and advise my friend to take the Cr-1/IR-1 route.

About 10 years ago the K-3 was seen as a good option. The wait time was about the same K-1 visa. Or at least I think it was.

So, we will follow the steps listed at :

We will have him fill out 3 separate petitions for his new family. As Darnell suggested. One for each of the persons he applying for. We will reference and follow the Checklist And then continue to read, reference and follow the advice given in the link listed above. I think I now have a much better understanding about what has to be done. When i first started this post I wasn't sure what direction to suggest to my friend to take.

PS Darnell, I have been to the consulate a couple of times when it was on Shamian Island I have never been to the newer one that was near Ikea and the East train station. As for the new one. I am not even sure where it is. As far as how they actually implement the application process, I have read bits and pieces of other people's stories. There are notifications, medical exams, requests for an interview, the interview, waiting and pick up the visa, paying for things and contacting the consulate, etc.. Bits and piece but probably not in depth details and updates. Is there a good explanation that we can read how the process goes in Guangzhou? I also hope that we will be able to seek additional advice from all you nice people out there. I will try to provide/get my friend good advice on how things should be done. Thanks again to all.

Danny Boy - deep apologies - when I first replied to you, I not know you were chasing a K-3 visa in China,ages past. Why did I not know that? 1] no timeline and 2] nothing set in yer profile. Only after reading your prior posts was I able to learn what's what with you. (Thank you, advanced search tool!)

for CR-1/IR-1 (and -2s) there's been a changeup, circa 2009 or so, with the doc intake at the National Visa Center - there's an Electronic Processing component that's optional, and it cuts down the wait time after 'case complete' timetick at NVC. Payment at NVC is online, so that's a plus. I've got a topic up at the wiki for NVC Electronic Processing for China, but I need to refactor it, as since 1 SEP 2013, everyone on the planet, chasing CR-1/IR-1 (2 and 5) must now file a DS-261 and DS-260, the DS-3032 and DS-230 are no longer utilised with NVC.

for the rest of it, medical exam and interview day - these are very straightforward. The medical exam place and the new Consolidated Consulate Compound are actually within 100 meters of each other. Also, since you first joined, a 'CHINA' subforum was added, so many posts about China, processing at Guangzhou, and other folk's experiences are posted there in that sub-forum.

Darnell, No need to apolgizes. Thank you for your reply. Yes i have been around for a long time. I find this site a very valuable for resource. Especially for one that gives a response ( That is understandable) when there are questions asked. The USCIS and other government sites are often hard to navigate. I think a lot of the information that they present is often not that easy to navigate thru and to get a useful answer.

The forms that you mentioned. DS261, and DS260. Those are forms that we will need to do after we send off the I-130 packet, correct? I will search the USCIS and see how to fill them out. This process gets to be a little confusing sometimes. Sometimes things are clear to me and sometimes they are a little "muddle". The path that we have to travel is a shared path but depending our circumstance we take a different path that may or may cross other's path...Maybe!.

Okay, we are going to work on the paperwork this weekend. Thanks again.

On a different note. I will look at the China sub section and see what it says. I like you avatar. Cute girls. Twins? Also that video with the lady kissing or counting with her fingers. I have seen it before in another topic. Very pretty lady. Trying to figure out what message that she is trying to convey. Something about "read it twice" ?

You won't find the DS-260 or DS-261 on the USCIS website. They're strictly a NVC (national visa center) type of deal. You can practice the DS-260 on the the DS-230 but you'll need exact addresses for all addresses since age 16 for the beneficiary.
