Hello,

My fiancee arrived to US about a month ago, all documents that came in the package, along with her K1 visa, were kept by immigration official. She was told that these were going to be mailed to local address shortly. We're about to get married and wonder about the whereabouts of these documents. These are originals to our divorce decrees and her birth certificate. Any suggestions as to how to find out to go about getting back our documents is appreciated.

As far as i understand you never get back any document inside the sealed envelope, we give it to the POE officer and he sent it to USCIS... is part of the process.... Don't you have another original or certified copy of documents you need to get married????

Wait what? All originals should have been returned right after the interview by the consulate. This is what happened with my fiancee. The consul just gave everything back during the interview. There should be no originals in the sealed envelope, they should only keep copies. They keep everything that's in the envelope. If the consulate sealed the originals in the envelope, then I guess you must contact USCIS and see if they can locate them for you.

I agree with the commenter below. You don't get anything back as long as you send them to USCIS . Therefore, you need to get a new copy of the said divorce certificates when your Fiancee apply for AOS. However, on the AOS, you can just send them a photocopy of the divorce decrees but original copies of her birth certificates. This is extremely important that's why I asked Mr. Hello to get a dozen (okay, maybe 5) of his birth certificates from the Philippines before he comes here as it's so much easier to have everything at hand. Also, get numerous copies 5 (?) of your/her divorce decrees (I did so on mine as easier!) and copies of your marriage certificates because you need to put a real copy of this in her AOS and you guys will not get it back.

Thanks for a quick reply! Honestly, I was not aware that the very same documents that they empasize need to be originals for the interview are not going to be returned to you. If copies were okay for the interview, I would have used those instead. We do have certified copies of decrees and one extra original copy of her birth certificate. I think a warning note should be posted as part of the requirement/processs for the interview where it lets people know that orignal documents submitted during the interview will be kept by USCIS.

"Todas las actas de nacimiento, matrimonio, divorcio, defunción originales NO se le regresarán al final de la entrevista."

My now husband had to make an emergency trip to another state where he got divorce to get me a certified copy of his divorce decree and travel also to juarez for my interview the nex day.

Exactly. It tells you in the instructions, "All original birth and marriage certificates, divorce decrees, and death certificates will not be returned at the end of the interview."

Always provide copies, including what you mail to the USCIS.
