which one to choose I-130 or I-129F?

hello vj members..... all of us here wanted to be with our husbands and wives as soon as possible right?... my husband filed k3 and our I-130 got approved quicker and now it is in the middle of process while our I-129f still pending.. i have two questions in my mind should we abondoned our I-129f and pursue our I-130 instead? and if we will do the I-130 after the case completed how long usually it takes in the philippine consulate to have my schedule for interview and medical? i heard they said it will take longer to have an appointment for that. Please all your comments and suggestions will be appreciated...

yodrak it is in MSC... NATIONAL BENEFITS CENTER... our case still there i guess they will not trasfer my case anymore((( just wild guess)

I think I would continue to pursue the immigrant visa and do nothing about the I-129f petition for the time being.

i would advice to contact the customer service regarding your status maybe that would help!!! :thumbs:

09/20/06 - I-130 Sent

10/03/06 - I-129F sent.

10/10/06- I-129F NOA1

11/28/06 - BOTH I-129F & I-130 approved!!!!

12/27/06 - NVC Left case no. assigned MNL 200685XXXX

01/26/07 - Received Packet 3

02/27/07 - Received Packet 4

03/01-02/07 - Done with my Medical Appointment at St. Lukes

04/17/07 - Interview at U.S Embassy - got the blue slip..on AR

07/05/07 - Went back to US Embassy submitted new affidavit of support for my K3, we'll wait for decision, still on AR

07/24/07 - OMG!!!! I cant believe it I got my K3 Visa in hand!!!

08/09/07 - Arrival in the U.S - POE at LAX

AOS:

08/27/07 - Sent AOS and EAD

08/29/07 - Chicago Lockbox received both AOS and EAD

09/18/07 - Checks cashed 09/21/07 - NOA on both AOS and EAD

09/27/07 - Received Biometrics Appointment Notice

10/18/07 - Biometrics

10/19/07 - Received RFE

10/26/07 - USCIS received the response to our RFE

11/05/07 - EAD Card Production ordered

11/16/07 - EAD Card received

11/26/07 - Received interview notice

01/25/08 - Interview Date!!!! APPROVED!!!

04/18/08 - At long last! GC Card production ordered

The new process that USCIS implemented holds the I-130 unless one specifically states on the form that they wish to obtain a visa at the consulate abroad if they have a parrallel I-129F. It does not state that the I-129F will be held and not transferred to NVC if one has an I-130. Your I-129F may be held up with security checks etc. As Yodrak suggests, pursue the immigrant visa via the I-130. This is after all, the biggie.

hubby already did called them but they said give them a time frame of 45 days for further action on our case. waaaaaaaaa

hi boowilson... well i was browsing thru your posts... and i would like to give you my comment on it... well my hubby and i filed for both petitions as it is required by USCIS... we filed our I-130 in Vermont and soon as we received our I-797, we filed our I-129F in Chicago... not long enough we got the approval of our I-130... was asked to pay for fees... for affidavit of support thing processing fee and so we did... even if it costs a lot... at the same time, we received an approval notice of our I-129F... you could just imagine how we pay double because of two petitions filed... but we jsut want to make sure we get have all the choices whichever comes first... and not long enough i had my interview and medical exam done... so all in all i have only waited for 10-11 months total for the K3 (not to mention that my husband was always out to sea so we were delayed for abouot 2-3 months in doing our paperworks) and now, just waiting for the visa delivery... well i do hope you get your interview soon enough for your CR1.
