I-130 Processing Times-Should I be worried?

Oh god, that must be frustrating.

The new NBC building is really mucking things about. I would have sworn on a unicorn you'd be done by 6 months. Was a US address anywhere on the petition or other information? Even if you put down one that you may be living at in the future, after immigrating, they may have sent it to a local office for that address, if your NBC was Lee's Summit and not Overland Park.

I recall one case from March and one from April getting approved quicker filed from abroad. But that's been it. I think that the "auto expedite" has gone the way of the unicorn.

August 30, 2014: Green card arrives in the mail!!!

April 28, 2017: Approval
May 4, 2017: Approval letter arrived

With Kansas taking over the reins it's hard to tell what is going on. I do look forward to the days when people could count on approvals going by chronologically and a firm knowledge of what is being asked for at the USCIS office (vs local offices who give NOIR or NOID for dumb things like beneficiary birth certificates.)

you are past processing times, liars.....I mean lawyers will give you faith as needed in these times. quote: you want something done right you do it yourself. Having a lawyer will show immigration you are indeed serious as well but I am sure you want more info more than....''Everything is okay''. Call USCIS, give your case # to the rep, request to speak to a 2 tier officer. DO NOT ACCEPT TO SPEAK TO A OFFICER 3-5 DAY LATER! Tell the ok, you will wait, in the automated system select them to call you back....1/2 hour to an 1 1/2 they will call you back...... tell them the same case info you gave the rep....Explain that you indeed know the case is out of processing time. Tell them make a request to the service center as to why you had no response, wait 15 to 30 days.... also, go on USCIS to INFOPASS


call USCIS EVERYDAY, request a 2 tier officer.... Infopass every 2 weeks if you have the time.....GOOD LUCK TO YOU AND YOURS DEARLY WITH LOVE

Can you explain to me that T-26 days till Overland in Kansas means?

At any point did you call and speak to someone or did you just wait?

I called several times and made an infopass appointment. Both were useless because they could not give us any better updates or respond effectively to my questions. I even made a service request (enquiry) over the phone. As I write, we have not received a reply to that service enquiry.

In the end, we resigned to just waiting until the approval came exactly 8.5months.

Can you please expound on what you said about NOIR/NOID, what they are and why they're being given? I just sent my package and am hoping there's nothing else I have to worry about, other than an RFE. sad.png

Wow, I guess calling wont make much of a difference then. So sorry you had to wait so long, I hope things speed up from here on out.

The local offices sometimes would send out a Notice of Intent to Revoke/Deny (NOIR/NOID) for the beneficiary's birth certificate. I haven't seen someone get a NOID noted on the forum from a local office since Darnell got one back in Feb 2013. Basically the local office should have issued an RFE, but didn't. The beneficiary's birth certificate isn't even needed for the I-130 petition but has been asked for by local offices who are using very old adjudication manuals. I wouldn't worry about it at all to be honest.

Hi,

I am a US citizen living in Montreal with my Canadian husband and our 2 kids. I am sponsoring my husband and we sent our I-130 in on March 28th, first NOA was April 5. We are nearing the 6 month mark and based on everything I am reading on the board and timelines we should have received our second NOA, especially since we both live abroad and our application should have stayed at the NBC and was not routed to a local office. Should we be worried at this point? Our attorney says we are still well within the current timelines and we just have to be patient. We really need to move before March of next year, and now I am afraid that might not happen. Any advice would be appreciated.

Hope things speed up for you guys,

We are waiting in France, only 35 days so far, but we are living in an extremely temporary set-up and the family here is moving away in a few months so we will be even more alone. We were so excited filing from abroad hoping for the auto-expedite...that is until reading further about the OP Kansas office not working yet.... We are on the same boat as we really need to get back by March as well... Lets all just see what happens in a few weeks when the new office opens...
