I-130 Processing Times-Should I be worried?

Hi,

I am a US citizen living in Montreal with my Canadian husband and our 2 kids. I am sponsoring my husband and we sent our I-130 in on March 28th, first NOA was April 5. We are nearing the 6 month mark and based on everything I am reading on the board and timelines we should have received our second NOA, especially since we both live abroad and our application should have stayed at the NBC and was not routed to a local office. Should we be worried at this point? Our attorney says we are still well within the current timelines and we just have to be patient. We really need to move before March of next year, and now I am afraid that might not happen. Any advice would be appreciated.

it looks like you dcf'd.. if that is true, you are way over due. at the very least a phone call to uscis by the petitioner is in order. after that, I think there are several different routes to go, but that is a start.

if your file was done through a lawyer in the states on your behalf, not sure how that works

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Canada doesn't offer DCF. Any I-130 petitions from canada are treated as normal. OP's lawyer is correct, right now unfortunately, it is within processing times.

without it being a dcf, but filed from abroad.. it is still an unusually long time for noa2.. haven't really seen any from abroad take longer than four months

You are right stevie b. Usually they are processed within 4 months. But everything is up in the air when it comes to I-130s right now. Its T-26 days till Overland in Kansas opens. Maybe the first week of October we will start seeing some long awaited approvals.

Can you explain to me that T-26 days till Overland in Kansas means?

My petition stayed at NBC the whole time and it took 8.5 months.

I would say OP is still well within the timeframe even though they're filing from overseas.

At any point did you call and speak to someone or did you just wait?

NBC is opening a new service center in Overland Park Kansas on the 30th of September 2013. Their division 8 will be dealing with I-130 petitions. -26 days is a count down to when the center opens.

Its a game of waiting to see how fast I-130s will start to be approved.

Ah ha, thanks for the explanation, sure hoping things speed up! We are about to sell our house and my husband, myself and our 2 kids will be living with my in-laws...in a 2 bedroom condo until we move. Kill me now.

Oh god, that must be frustrating.

The new NBC building is really mucking things about. I would have sworn on a unicorn you'd be done by 6 months. Was a US address anywhere on the petition or other information? Even if you put down one that you may be living at in the future, after immigrating, they may have sent it to a local office for that address, if your NBC was Lee's Summit and not Overland Park.

Oh man, I was afraid of this. I read on another thread about this happening and yes, our attorney used my Mom's address in NY as the address we intend to live in the US, all other parts of the application stated our perm address as Canadian. I have heard the wait for the NY local office is insane! Do you think there is any chance someone will talk to me if I call at this point? We are not going to live there and my Mom is actually getting read to move to Texas. Ugh...I think I am going to cry.
