my K1 Fiancee did not apply for a Social Security Number before our wedding

Hi all.

She has been with me in the USA for 55 days now. We went forward with the marriage before having her apply for a social security card.

I see that the K1 Flow Chart recommends that we apply for her social security card before the marriage. We planned to travel to the social security office in two days.

Have we made a significant mistake by not following the "order" that is detailed on the flow chart?

na, just apply in visa name. once there's a government-issued id in married name (EAD or greencard) can go back and have it changed.

You'll be ok. You now have a choice of whether applying in married name or visa/maiden name.

Most SSA clerks are a bit confused with K1 SSN after marriage though. They tend to tell you to apply SSN after AOS if you apply SSN after marriage so as what is frequently advised, apply with visa name even after marriage then just change your name after you receive EAD or AOS or your certified true copy of marriage certificate.

Some office clerks are ok though as they understand like mine did so I applied with my married name by bringing a certified copy of my marriage certificate, birth certificate, passport, visa, I-94, and a filled up SS-5. It saves one trip to the SSA office but like I said, not all clerks are like that and might give you a hard time instead.

Most people would still advice you to apply using the maiden/visa name even after marriage then just do a name change after. You can take your chances though if you want. :)

My wife did not apply for her SSN until after we were married as my wife wanted her card in her married name, had absolutely zero issues. You can apply for her SSN in the name in her passport or your can bring a certified copy of the marriage certificate and get it in her married name.

With that said SSA seems to go to the Forrest Gump Employment Agency and hires only idiots in some parts of the country... and those idiots could give your unnecessary grief.

I blame myself for not following the Visajourney flow chart on this.

I took time off of work to take my bride to the Federal building in Columbus, OH. After waiting almost 2 hours to see a Social Security registration clerk, I showed them a copy of our "certified marriage abstract". The clerk would not let my K1 bride use her "new" marriage name (clerk said she could only register my bride with her maiden name that was the name shown on her passport and K1 Visa). Then the clerk left to "look-up" something about us...., she came back with another clerk and they told us that, since we were NOW married, that my wife could register for a Social Security Number until we completed the AOS.

I explained that I needed to get my new wife a Social Security Number so that I could enroll her in my health insurance (began paying the premiums for her and K2 son two days ago), and the clerk told me to go to the IRS office and get my bride a "tax ID number" (with which I should be able to enroll my bride into my health insurance).

We waited at the IRS office for 15 minutes, spoke briefly with a rep......., it was then after 3:00pm......., they told us to come back tomorrow.
