AOS Question..need a bit of help

Don't know if I am in the right forum area or not. But I am just covering my bases since my fiance has his interview in 2 weeks for his K1. We are wondering what are the next steps and forms I should print out and start preparing for his AOS and EAD?

I am so lost on this topic I don't know where to start.

First of all I wish you the best and a happy outcome! Well basically since he is still waiting for his visa to be approve there's not much you can do right now, but get familiarized with the AoS process. Basically you will be submitting his i485 petition along with the EAD and AP (work and travel permit). While you guys wait, read the "step by step how to fill aos". It's a fool proof list of things you need to do and thing you need. Its not complicated at all. Just a couple of forms, copies...the most difficult part for my hubby and I was the i864 or affudavit of support which is a little long form, but if you read the instructions you can do it within 20 mins. My hubby and I built my AoS package in 1hr and half. Its pretty simple. Some tips: he needs to bring a copy or oiginal of his birth certificate, make sure he brings all his personal doc. You also need to submitt a copy of your NoA 2 from your i129f, so make sure to keep it in a safe place. Sometimes people don't think they longer need it and throw it away, but that's a horrible mistake cause a new noa2 cost around $400. And my last tip is make sure when you guys get marry, ask and pay for at least 3 CERTIFICATE copies of your wedding certificate. You need to send an original one along with your package, not a regular photocopy. Besides that, my advice will be get marry and Adjust as soon as you can cause the AoS process takes a lot of time. In the mid time, relax and enjoy your triumph :) :) :) P.D: almost forgot! Make sure he brings also the copy of his vaccination record signed and dated by the civil surgeon

Thank you sooo much! That makes me feel so much better! It feels like the rock in my stomach has gone away for now..I'm sure it will return when I start the process lol!

your welcome girl! Is just a few tips cause most of us never started thinking about AoS until we actually arrive here to the US. Thanked to my Lord, I have a light form of OCD so I made sure I bring everything I could posibly need cause I was living alone in my homecountry, so If I forgot something I was literally screwed :);) and my hubby made sure to keep all our documents also in a safe place. But trust me, Im tired of reading threat about people who didnt bring birth certificates or they simply got their noa2 lost. But in general terms is way easier than the k1 package! 5 short forms and a bunch of copies. You dont even need to send any kind of proof along with your package (photos or receipts). Once you send it just wait for the noa1 and the biometric app letter (it usually comes together). The biometric app is just like 10 min, they will take him a photo, his fingerprints and signature, that's it. After that, you have a long wait. Usually witjin 5 or 6 month u can get an interview app or have it waive like me. I got my gc approval within 9 month without interview. In the mid time he can get his SSN (make sure to take him at least 2 weeks BEFORE his i94 expires) otherwise, you will need to wait for his ead to get it. Im not gonna lie to u, the first 2 month are fun and romantic but eventually reality strikes. He is not gonna be able to work or drive at least for 2 or 3 month and be at home alone and bored can take a toll on everyone. Make sure you can involve him in your family and community activities, or enroll him in a gym or some activity he can enjoy while you are out working. This way, he can start adjusting to his new life and make new friends. Life for us the beneficiary can be kind of boring and lonely at the beginning without family and friends around.

it's a one page summary of the three applications and supporting documentation to give you an overall picture or checklist to go by. I had most of it filled in before my fiancé ever left England. There are a few items on the form like asking flight number that may not be arranged yet, but most can be done right now. We managed to get our marriage certificate the morning after the wedding so were ready to file quickly, having done most of it in advance.

Should I use my hubby family name or my maiden name as on my visa and passport...

You should use the name you plan to go by as a married woman. Your greencard will come in the name on the application. If you plan to be Mrs. [husband's last name], then use that on the AOS. It does not have to match your passport or visa. They know you just got married.

your welcome girl! Is just a few tips cause most of us never started thinking about AoS until we actually arrive here to the US. Thanked to my Lord, I have a light form of OCD so I made sure I bring everything I could posibly need cause I was living alone in my homecountry, so If I forgot something I was literally screwed smile.pngwink.png and my hubby made sure to keep all our documents also in a safe place. awww I had to share your post to my fiance he thought it was just as sweet as i do :) I can totally understand about the slight OCD lol tis why I am getting a heads up now on starting to get things organized ..and as far as a gym membership I already got him set up and ready to go lol :P

Hey Nich, may I ask you, I was reading over the link you gave me and in regards to sponsor information, I am just shy of the income requirements of being my fiances sponsor, I asked my mother if she could be his sponsor with the K1 can she be his sponsor again for the AOS? Does he need me and my mom or would it be just her again? Sorry I know your the guru of all of this and any feedback from you is always appreciated :)

I -864 has more specific instructions and requirements (by law) than the I-134 and London. You will each provide an I-864. The minimum documentation with yours is a 2012 tax return. Mom's documentation is detailed in that list. Don't forget her proof of being a USC.
