My Cousin filed for her sister back in FEB 2001 and now she is going through NVC process and we have question about I-864 and the obligations. We see it says its a legal document/promise between the sponsor and the US government . what happens if the immigrant comes here after 3 years the household of US sponsor get larger and he/she can not support the immigrant?

We also read this on DOS website :

No. Even though the I-864 is a contract and the U.S. government prohibits giving immigrants most federal means-tested public benefits for at least the first five years after their arrival in the U.S., consular officers look at other public charge issues. They will look at the complete financial situation of the sponsor and the applicant. This means looking at the age, health, education, skills, financial resources and family status of the applicant and the sponsor. They will confirm to the extent possible that the applicant will have adequate financial support and is not likely to become a public charge.

Can someone please explain FIRST FIVE YEARS is that a hint where it says ok yes you MAY apply for some FED benefits ?

because after 5 years the person can apply for citizenship, 90 days prior to being a LPR she can apply for citizenship and the sponsorship will end, she won't have any obligations anymore

on the instructions of the i864 there is a list of ways the obligation ends

the support is only if your cousin gets government assistance that are means tested benefits, the government can ask your cousin to repay the benefits that her sister requested
