IF denied @ interview.... then what?!

If we are denied at interview, is this the "221g" that I've been reading about?

if so, do we have a chance to send them the required docs and then get approved once again? Would we have to pay again or no? Would we have to go through the entire interview process once again??

Also, At what point would we have to pay for the interview again and what is the process for "appealing" an interview to be overturned? Is there some situations where we wouldn't be able to appeal or submit additional docs to appeal the denial? If so, what are some examples of this?

Thanks in advance.

Embassy refers to the 221g as a temporary refusal, most times that is a request for more information or more documents. If they receive what was requested, after another review of your case then they will decide to approve or deny.

If the embassy actually issues a denial the case file will be sent back to USCIS and any appeal would be handled through USCIS.

Best plan is to not go down that road.. ;)

If you don't mind an old man answer... after a 221g, if you provide the requested evidence, you will be interviewed again, no extra cost. You can also request extensions of 4 months for up to a year (sometimes more than a year, case-by-case) thru USEM.

You have to pay again if: you stay in the PI for 6 months past your medical exam (gotta arrive in the USA within 180 days of the exam). Or if you let your case lapse with no activity and without requesting an extension, you must start over. I "believe" the first extension is automatic, but we didn't take a chance with that, I called USEM to request it as soon as I knew I would need it. They told me they would keep the case active for a year, no need to call again in 4 months, so I didn't.

Thank you both for the prompt replies. Yall ALMOST answered all my questions, hehe....

And also, how long do we typically have to submit the add'l info and what are some common 221g's that ppl get? yeah hoping we dont get that that's why im trying to get informed now vs later :)

I really don't understand why you are stressing yourself out at all.

what petition type are you? it would help if you had a TIMELINE!!

most refusals will be for one of two things.. either a co sponsor in the case of a 134/k-1

or

an outright denial based on them not believing the relationship is real (applicable to fiancées and spouses).. if you get this.. it will be a really long time to resolve

these things are embassy/country specific so go to your country's forum and spend the next 12 hours or so reading reviews.. scroll through igors list looking for recent approvals and their posts on their experience.. read about other folks experiences in general and you will generate your own long list of things that might come up

remember this is mostly a do it yourself site.. the answers are all there, just go find them.. if you want to be spoon fed the answers, chances are you will miss out on essential nutrients

additional information is usually available by going through all the links at the embassy you will use as well

You are asking a rainbow question... you can do a search of the forum for topics on denials or 221Gs they are out there.

Getting informed on denials isn't something I would waste my time on, unless you are sitting on a "issue". Personally I would focus my time on getting everything ready for the interview and not look back. The interview is not hard for anyone in a true and ongoing relationship.

It's always best to be prepared and work towards not having an RFE/221g, of course. If you follow Hank's guide, and bounce it against the K1 guide at the top of the page, you should be golden. And of course, ask questions when you read something but don't understand it.

The only case where I can think of where an all-out denial without appeal would be a case that reeked of visa fraud.

Too many RFEs to list them all. I think there is a link here somewhere listing RFEs, but I don't remember which forum it's in.

Did you have to take the medical again?

Did you have to take the medical again?

No, we just waited several months before we did the medical and then interview. the only thing that tripped us up a little bit was that the 180 days starts from the medical date, not the interview, and we were planning on 180 days from interview. But we were ok in the end.
