I'd love to find out what courier they use (maybe shipping by horse and carriage)between the USCIS office and the NVC. We could conceivably track things, or at least, track a little activity in a similar fashion as we do now with Case to Embassy petitions.

It is ridiculous! I don't even want to call to be told wait 6-8weeks.

Hello to everyone!

I am new in this forum although I was following it from the moment I found it in google (a couple of weeks ago).

I am from Madrid and my fiance from Fort Worth. We are very frustrated too because we see how cases from the same day as ours are already in post-decisions and many cases filled much more late than ours already got NOA2 a month ago. This is taking so long and we feel so helpless since there is nothing we can do. We not even knew that I cannot go from Spain to spend the Xmas time with him & family in USA and we were so very excited about that. He went to a lawyer a couple of weeks ago and lawyer said that if I try go to USA they will deny me in customs sending me back to Madrid, but even if they will let me in, inmigration will find me and send me out of the country and will ban me to travel to USA and ban asking for any kind of VISA along the next 10 years. That is so frustrating, they treat people like criminals when the only "crime" is being in love and wanting to spend our first Xmas together. That is so unfair.

We filled the I129F in september, we got the NOA1 the day 23 of september and 17 of october the alien number. No more news from then. This way we won´t be able to spend together no Xmas, no St. Valentine... and we wanted to get married in march the day of our anniversary but all is going so slow that I guess we won´t be able to make true that dream either... and reading the last posts about that after NOA2 things are not esier or faster, that does not cheer up either. I truly cannot understand how living in the computers and internet era all this goes so slow. How can the case last 8 weeks to be sent to the foreign country? Are they sending it in donkeys?

I am sure that if just a single person who made all this laws and burocracy about K1 would have to pass by the same, this would be much different. The problem is that nobody cares about the other persons, they treat us like cases and not like in love couples who cannot wait to get married and start their lifes together.

I'm so sorry this is happing to you and there is nothing worst then people telling you to hang in there. This whole process sucks! I think they are sending the petitions on donkeys.

All I keep thinking is, next year I'll be married and spending Christmas for the first time together in the states.

How do I know if my NOA2 went to the NVC or DOS? I've called NVC and they told me they haven't received my approved NOA2 (like most of us) but how do I know it's not at the DOS? Or is the DOS and the NVC the same thing?

You will get another notification from USCIS just like you did for NOA1 and NOA2. NVC and DoS are effectively the same thing. DoS can give you the same answers NVC can with a shorter time on hold. I called twice. The first time I was on hold for 5 minutes and the second time my call was answered right away. Hang in there.

The attorney gave bad advice. Having an I-129f in progress is not grounds for denial or a ban if coming over to visit. I can see the denial if you don't have sufficient ties to Spain or if they feel like you are coming with the intent to immigrate. You can visit. My fiance visited me in Texas while ours was in process and there was no problem. Having your I-129f in progress shows you're doing things the right way. What you cannot do is come over to visit if you have an intent to marry while here "visiting". You can absolutely visit. Check into it more here. Best of luck.

HI! So we received an RFE notification this morning at 8:30am PST. Has anyone here received an RFE and what are they usually for? From what I hear they act pretty quickly once they receive the evidence.

Any advice is appreciated.

The information the lawyer gave you is untrue. He sounds like he enjoys scaring people, especially with talks of a ban. There is a thread at the top of the main board detailing how you can visit. If you still want to visit over Christmas then please check it out. It basically says you need to provide evidence of strong ties to your country to show you intend to return.

I entered the states in October and am leaving in two weeks. The immigration officer did question me for a little while longer than normal, especially when I said I had finished at my job. What he seemed to like though was when I said we were in the middle of applying for a K1 visa and wanted to wait out the process together. I guess it does show intent to immigrate, but through the proper channels which require interviewing in the embassy at home. I took a copy of my NOA1 but didn't show it as he didn't ask for it.

I obviously cannot tell you if you will be let in or not, but even if you are sent home direct from the airport it doesn't harm your visa application. If spending Christmas together is important, go for it! For me, I wanted a last Christmas at home as there will be plenty of American Christmases.

Good luck! :)

Well... Just got off the phone with D.O.S. And the agent there was SO much nicer then the ones I have talked to at the NVC. She was saying that our file (and I imagine many others on VJ) have most likely arrived and are just waiting to be put into the NVC system. She said since the holidays are starting to hit it's taking a little longer. I encourage people to call D.O.S. for a polite helpful response. She was actually encouraging me to call them everyday and check.

To volkditty: congratulations!!

Hi! That's what I am reading. It could even be a box that was not checked correctly.

We included a full scan of passport of every single page; travel visa's i purchased to visit him; flight records for my 3 flights there; flight records for several flights inside the US together; photos from past 2 years including marathons and triathlons we completed together; engagement cards from family/friends; emails including our first correspondence when we met; whatapp messages and so on... the only thing i didn't include are electrical/cable bills with his name on them.
