i need some information, i knew a couple that having a problem with their marriage life, the guy expect the wife to stay at home and take care of his adopted child, the girl raised by a grandmother and dont have parents as she grow up to help her grandma, now before the girl left her country, the husband knows that she has to support her grandma and the guy promise that he will help to support, when she came here they got married and the guy make her sign a pre-nup which is she dont hesitate to sign as she never meant to marry him for his money, months after and so, things make complicated as the wife ask her husband if they can send some money to granny and the guy is not happy about it and now starting counting the money he spent for her. they apply for a greencard but as soon as she receive it he returned it to the uscis and wants his last name to be used which is the wife agreed on it.now the wife wanted to work as her husband dont want to help her support the granny, husband gets mad and dont want her to work,he told her that your job is to take care of my child.the wife gets worry as her granny is very old and cant work anymore, then finally the husband let her work as part time only but he wants to take her pay as he said he need to track how much she make or where she spent her income but in the first place she is not on his bank account or any other property as he dont want her to have any acess for what he has and dont give her any dime as the husband said she dont need it.Now the wife felt he is very controlling to her, all she wants is to have her own income and can help her granny. husband keep counting the money he spent to get her and filing the paperworks and the wedding and the whole nine yards! one day the husband forgot sign out his facebook and when the wife open the fb page it pops up the husbands page and busted him for chatting another girl and telling the other girl how he regrets marrying her. the wife is so devastated and broken badly, she wants to go back to her country but her GC is still on process... Guys i need your opinion for this situation, what is my friends option if she wants to stay her in the us what are the chances of her not getting her GC ?

it was issued already, so that's a plus.

It's just waiting for the new name in the greencard, so that's some wait.

if she wants to leave, she could leave tomorrow, regardless - what does green card matter if she's no intent to return or stay married ?

If she needs 'papers' she can go into uscis local office on an infopass appointment - they can give her a one year I-551 stamp in her passport.

If ever i will help her to stay her in the US as she is very good girl and i really feel bad for her situation, can we change the address on the uscis so they will not send it to her husband home address? does her husband can stop the processing of her greencard? she have it already but send it back as the husband wants his name on her GC.

You say you'd like to help her stay in the US, but your first post says she wants to go home. What does she want?

to be honest she so lost right now and dont know what to think, but i try to told her that my door is open for her if she wanted to stay here in the US. I am just trying to get some information what are her options if she wants to stay

Taking your post entirely at face value, it seems your friend married a a..hole. Unless he has been cruel and abusive to her - which he has not - she has no grounds to keep her green card if she leaves him before ROC. If the marriage is over she is better off calling it quits and going back home, where she can actually help her grandmother.

her husband dont hurt her physically but emotionally. she said she wants to go home but being a friend i think she is better off here in the US to work so she can help her granny. I can't make her decide yet as of now as she is very hurt.she loves her husband more than anything. I am not in the position to dictate her what she supposed to do as she is on the right age to decide for her self. i just want to know your opinions of her situation if she decide to stay without her GC on hand yet and wants to leave her husband.All i can do know is to listen to her and being supported whatever she decide... thank you guys for the inputs.

yes she only a 2 yr greencard. in fact she only been here in the US for 9 months, and this is what happened.

If she has the 2 year GC, she can stay in the country until that expires.

She will have to do removal of conditions within the 90 day window before it expires to obtain the 10 year GC. It doesn't automatically happen and must be applied for at the correct time (check the guides).

I suggest she talks to her husband first and try to work their relationship instead of just running away or plotting behind his back. Let's remember, that this is about a MARRIAGE first instead of just getting a visa/green card/status.
