Well, they're SUPPOSED to, but considering how unreliable and inconsistent their process is, who knows. How awesome that you get to see your hubs soon! Mine will be here visiting with his father in March. I would love to celebrate another step forward in our visa journey when he's here!

Well i have my fingers crossed... if any progress happens with my petition they may not let me cross the border. I am at the COMPLETE mercy of the border guard at the time of my crossing. He/she can completely deny me even if i have a letter from my employer stating my intent to return :(

Did you overstay before? As nightingalejules said, you shouldn't have any problems visiting during the visa process. From what i've been told before when I asked for my hubby, the border patrol cannot see that you've filed for a visa, only if you have been issued one. Though, I'm not familiar with driving into the states, only flying in, so I'm not too sure about what information they may have available for your situation. :\ I'd ask other people in the Canada board to see what they say.

Ok so I was reading August i130 .. and most of them got transferred and some approved.. almost at the same time.. they are doing a spreadsheet and it seems its by their MSC numbers..

He warned me not to try and cross the border AT ALL actually but i've talked to people to have and thought i would risk it. I would be flying there. A friend of mine has a K-1 visa and she has crossed the border a few times already. She did call once to "feel it out" and the border guard she had on the phone was rude and told her that she couldn't cross. I'm basically gonna try and see what happens.

How strange. Would this be this first you've visited since sending the petition? My hubby has already come over twice on VWP since filing and was honest when they asked if he intended to move here eventually since he said he was visiting his wife, and he said yes, that we filed the I-130 and are waiting for its approval, and they just nodded and stamped his passport. As long as you have a record of leaving when you're supposed to, and sufficient evidence of strong ties back to your country, I don't see why they would deny your entry. Only answer the questions they ask and provide evidence if required. Don't give them more information than they ask for.

Yes this is the first time i will be crossing the border after filing our petition. I have phoned the border guards at our airport and they have said that as long as there is NO movement with our petition i can potentially cross. Could just be our border guards here in Alberta.

I have no idea what VWP is...

VWP is Visa Waiver... something that starts with P. It means that we don't need a tourist visa to visit the US.

I've been going over the border (driving, though, not flying) with some regularity since my I-130 petition and haven't had any troubles so far. A few more questions each time, so I'm guessing that they see that I have a petition in the system, but I've always been going for a short (under 2 weeks) stay and had work to get back to.

Are you in Edmonton? That's where I'm from originally and I have noticed that the Customs people seem to be a lot tougher there than in most airports I've been to.

No i'm in Calgary. My girlfriend who crossed the border regularly is from Vancouver and she had NO problem but it was a K-1. Here's hoping!!
