Hi Everyone

Lots of information here! I file my petition like everyone here on September and it was received and approved now is in Initial review. I called the USCIS last week to see what was going on and they are on the March files still! Anyways I have a question, me and my husband are in Egypt at the moment and I will like to travel with him back home for a few weeks he doesn't have any type of visa and I was confused if I should file for a Tourist Visa for him or the K-3. Any ideas, what should I do? Or do I have to wait until the I-130 process is done so we can travel? Thank you and sorry for the question is very confusing this process for me!

There's a lot of debate over whether the K3 visa is good for anything (generally speaking, it's not). And even if it were, it's not likely to help you now - they're sitting at a theoretical 5 month processing time for K3s, and the clock wouldn't start until you applied.

So the only option to bring him over for a visit before your IR1/CR1 process is complete is a tourist visa. And that's not guaranteed, by any stretch of the imagination. They may well refuse him one.

But even if they do refuse the tourist visa you're just in the same boat you were in before: waiting for the spousal visa. So if you can afford it, why not take a chance. Being denied a tourist visa does not affect your application.

Sorry to hear that your expedite request was denied. It must be such a terrifying situation!

I'm glad you and your daughter are safe.

Wouldn't it be nice if September got a bunch of approvals in March (or earlier!) Because then my husband and I might get an approval for our birthdays (a week apart at the end of April!)

April 8, 2013- NBC opened its new office in Overland Park, Kansas, where Adjudications Division 7 will process Form I-90 applications. A new division, Adjudications Division 8, also will be located at the Overland Park, Kansas facility. NBC anticipates that Division 8 will begin to adjudicate stand-alone immediate relative Form I-130 petitions by the end of Fiscal Year 2013.

Its been 136 days since our NOA1 and now its just annoying knowing we might have to wait just as long more! Plus it makes me so sad to know my husband is missing out on seeing my 8 month old daughter do things for the first time! :(

Just a small clarification on your terminology... when you stated you filed and it was received and 'approved', it was not approved, it was a Notice of Action (NOA1). Approval will refer to the NOA2:)

And I wish you luck on getting a tourist visa!

Found this online....

April 8, 2013- NBC opened its new office in Overland Park, Kansas, where Adjudications Division 7 will process Form I-90 applications. The Kansas facility is where all petitions went to from early 2013 until at least Oct 2013, but really no processing went on and the facility didn't open as expected. Hundreds of thousands of I-130 petitions ended up there collecting dust until a distribution process began in Oct, which led to the petitions finally being sent to the other 3 Service Centers to attempt to catch up on the back-log of paperwork.

If you refer to any of the earlier I-130 threads for months of 2013, you'll see everyone commenting on being transferred. A transfer to an active Service Center leads to an eventual approval (NOA2).

It's not clear whether the Overland Park facility will open, although others may have seen posts dealing with this question in other threads, and may have more information on that.

Thank you! I appreciate it. I guess I will try for the tourist one and wait it out. Crossing our fingers that by some miracle they approve the tourist one and that our IR1/CR1 gets done soon!

Even though your husband cannot support your or your child he still has to file his I-864 and the sponser must file an I-864 as well.

I've seen it repeatedly stated that applying for a tourist visa will not affect your application, however successfully getting that tourist visa is the hard part.

I suspect there are other threads that may also link or discuss valuable information which will help you.

Type in 'visitor visa during I-130' and quite a number of even more relevant looking titles appear.

Seemingly, it's that your application will affect your tourist visa, rather than the other way around.
