I know this post I am about to write doesn't belong here but it's good information and we don't have a lot to talk since we are all waiting.

Questions and doubt are still around about your spouse coming to visit the US while I-130 is pending. For my experience, it's possible, I didn't see anything written that prohibits it. My Wife came to visit me at the beginning of this month ( Oct 2-7) I know only 6 days , but those days were incredible. To see my wife after 4 months it's just awesome. ( I feel your pain and sadness when I read about 12-18 month separation, it must be tough) Anyway. POE was Miami, and this is how it went:

CBP: Purpose of visit

Her: To see my husband

CBP: How long are you staying

Her: 6 days (She provided return flight itinerary)

And that was it!!!!!!!!!!!!! She was granted a 6 month stay under a B2 Visa

Guys, Girls... It's possible to see your significant other, the lawyer I contacted says she can come as long she doesn't go over the time CPB grants her upon entry.

I was freaking out, I thought she was going to ge the visa deny, or being sent back from Miami, but as long as you are true, have good evidence of doing this legally, and not intending to stay illegally

I grabbed this from a document and gave it to her to show at the embassy and BCP

9 FAM 41.31 N17 AUTHORITY TO CLASSIFY
CERTAIN VISAS “B-1/B-2" AND AMOUNT OF
FEES TO BE COLLECTED

(CT: VISA-1034,-

You may properly issue B-l/B-Z visitor visas to aliens with immigrant visa
(IV) applications pending with the United States Citizenship and
Immigration Services (USCIS). You must be satisfied that the alien’s
intent in seeking entry into the United States is to engage in activities
consistent with B-l/B-Z classification for a temporary period and that the
alien has a residence abroad which he or she does not intend to abandon.
While immigrant visa registration is reflective of an intent to immigrate, it
may not be proper for you to refuse issuance of a visa under INA 214(b)
solely on the basis of such registration, unless you have reason to believe
the applicant’s true intent is to remain in the United States until such a
time as an immigrant visa (IV) becomes available.

We are planning a trip for this upcoming holidays, I let know you how this time goes. Sorry for intruding our post with this, but I thought you wouldve like to know and maybe try it as well, I believe we are really getting screwed with this waiting game, according to USCIS 11-16 months, I don't know anymore. But maybe you guys can shorten you distance and see each other for a couple of weeks, and live like a real marriage, like it should be.

Regards,

And let's keep on waiting!!!!!! Love it, just love it to see USCIS believing Fiance is more important than Spouse (Sarcams)

nice... but I think that applies if you already have the B-2 before sending off the I-130. anyone have success applying for B-2 after sending I-130?

Being granted a B-2 visa while I-130 pending is not impossible but highly unlikely to happen.

Even if so, B-2 doesn't guarantee entry.

Entry denial would not have any effect on IR-1/CR-1 process. It would be just money wasted and a lot of stress.

k.dlg, I can totally relate. When my hubby left me in September, I dragged...couldn't sleep well coz I missed him. I kept wearing his t-shirt to bed until it was just too gross...and when I washed it, I lost his "smell" and cologne. Totally lovesick. It's horrible. My 3-year old son keeps asking where he is and when he'll see him again. It's just hard. Last night, we were up on skype til 4am my time...coz I'm just having one of "those" weeks where I'm missing him. At least we know there's light at the end of the tunnel and this won't last forever. The in-between is horrible, though. My hubby's English too, by the way--just living in Holland. good.gif

Exactly. That's what we keep telling ourselves. This process and wait will be a blink of an eye compared to the time we'll be together for good. :) And awesome! Will he still have to interview in London or would it be Amsterdam?

Thanks, girl!

But... that makes me think OP is not working yet.

Hey Blue, I guess you didn't see this :(

"Posted 19 October 2013 - 02:43 PM

I just ran into the immigration lady who works in Kansas City, and I asked her about Overland Park. Sorry if someone already posted this I haven't read the above posts...she said Overland Park is not fully operational yet and they are still hiring ISOs. She also mentioned that the government shut down has delayed that hiring process but they may be back on the hiring trail. She didn't know when it would become fully operational. "
This is our latest report from our "stalker" in KS he lives there and was kind enough to inquire in our behalf basically the are "hiring" so no processing yet at least it appears that way, USCIS told me that our files might be at Lee Summit getting processed there but again is only a guess because no one knows for sure where our files are :(:( I hope there are at LS at least we have a better chance, they have working people in the building ... Prayers of hope to everyone !!

k.dlg, exactly....and the fastest that it can happen will not be fast enough, right? Totally how I feel. Hubby keeps telling me to keep a stiff upper lip, so to speak...and I'm tryyyyyying. I'm sure you understand! wacko.png He will be interviewing in Amsterdam. I'm really hoping they'll just be really fast. So far, though...Amsterdam has been ridiculously slow in getting him things. The police certificates took almost 5 weeks. I'm going to just hope things go quickly anyway!!! Is your hubby interviewing in London? Do you know how they are?

Hey Luv! Yay...December isn't too far away! So let me try to answer you here...

1. NVC communicates via email on only a few items, unless you're in a specific group of countries. (http://travel.state.gov/visa/visa_5162.html) Egypt doesn't appear to be one of them. So, most likely, you'll be doing this via the regular mail. (I'd recommend using FedEx or something to be SURE everything gets to NVC.)

2. I'm not 100% sure, but, as I understand it...this is my best answer: she could list the income as her income if she receives the payments. However, if the payments are made TO the son, then he would probably be considered a co-sponsor. The thing is...if he's disabled, maybe he can't be, legally speaking--he may not have the "ability" to make such a judgment...if you know what I mean. If you want to message me privately, if you have more info...then I can try to help you out. I do know what you mean about that form--it is VERY confusing. I had to spend 2+ hours on it and redid it and spent another 3 hours fixing it....never had such trouble with a form...

3. Take most of the stuff with you, but leave him with one copy of your marriage certificate. You also need one to send in to NVC. Read this for help on what you will need to send: http://www.visajourney.com/wiki/index.php/EZGuideSpouse ... also, have him fill out the DS-230 with you and bring the signed and unsigned parts WITH you so that you can send them all in from here...that form is a pill, so, I'd do it now and get it out of the way...You can't save it and you have to do it on a PDF. You also can't write on it.

4. Everything that is not in English MUST be translated. Don't send it in without a translation or you will get a checklist, which will only delay you. You can have your husband do it if he is fluent in English and Arabic (and any other languages that the documents may be in)...is he? If he is, you can have him do the certification himself and they will accept it, which is cool. I can send you a link to that if you need the text. I asked the same question about whether I have to send another copy of the translation and the answer is YES...another copy, but you can just use the translation you already sent. But, they do want originals of everything now....which is a pain.

Do not worry--the questions you are asking are all reasonable and fair. I asked all of them in the NVC forums. You should join us there, actually. Hey Blue, I guess you didn't see this sad.png

This is our latest report from our "stalker" in KS he lives there and was kind enough to inquire in our behalf basically the are "hiring" so no processing yet at least it appears that way, USCIS told me that our files might be at Lee Summit getting processed there but again is only a guess because no one knows for sure where our files are sad.pngsad.png I hope there are at LS at least we have a better chance, they have working people in the building ... Prayers of hope to everyone !!

I think I've seen it...

Their hiring process is very lengthy and complicated, so.. OP might not be fully operational for a long time :(

What I now think though is that NBC/Lee's Summit, with all the recent transfers, is making room for all Overland Park files.

Although.... MSC1391809919 this case is PD 9/6 like mine. And was just transferred to a local office. Weird.

When two people are meant for each other, no time is too long, no distance is too far, no one can ever tear them apart.
