September 2013 I-130 Filers

Wierd... I called on monday which was a little over a week from our NOA2 and xfer to NVC. They were kinda curt with me and were like call back in 4-5 weeks. Today I received emails with the AOS bill and case number! Totally didn't follow the NVC guide where we are supposed to call and hound them for this information... At any rate I'm waiting for some documents from Vladi and from my employer. Of course the IRS isn't cooperating tonight by letting me log in and get my tax transcripts for 2013.

I'm very worried though. Vladi was born in Kazakstan as a Volga Deutsch. His family was repatriated to East Germany in 1982. We have his original birth certificate. Of course now I realize they want a "certified" copy of this. The problem is when we were unable to find his BC back in 2012 before we got married in Germany they told us if they had to order one from Kazakhstan it would have to be coordinated by the German Embassy there and that it isn't guaranteed that they could get a copy. This is very disappointing. I can get his BC notarized but read that won't work at all :-(

Well, first you actually didn't have to hound them. I can assure you that you were not delayed any by not calling them :-)

Second, why wouldn't the original work? Is it the long form that has both parents' names listed on it. I think you could try calling NVC on Tuesday to get clarification or ask your BC question in the NVC thread as this is discussed quite often :-)

The problem with sending the original we have is that it might be the ONLY copy of this existing anywhere. Honestly, its hand written in Russian with CCCP. So basically he was born in a country that no longer exists to Ethnic Germans... kicked out when he was 3mos. old sent to a country that now also no longer exists! I did put this over at the NVC thread.. so maybe I will get some info there.

Oh wow! I can understand the hesitation in sending that in. I would definitely call NVC as well.

The problem with sending the original we have is that it might be the ONLY copy of this existing anywhere. Honestly, its hand written in Russian with CCCP. So basically he was born in a country that no longer exists to Ethnic Germans... kicked out when he was 3mos. old sent to a country that now also no longer exists! I did put this over at the NVC thread.. so maybe I will get some info there.

Shot in the dark but.. I think USCIS has secondary evidence you may submit instead of a birth certificate (I think it talks about it in the I-130 instructions). Maybe NVC has something similar? Or they may accept it if you offer?

Shot in the dark but.. I think USCIS has secondary evidence you may submit instead of a birth certificate (I think it talks about it in the I-130 instructions). Maybe NVC has something similar? Or they may accept it if you offer?

Yes there is an option. But they ask for proof from the issuing agency that its not available. That proof or the copy could take MONTHS and MONTHS to arrive.

I don't know... I guess I'll call on Tuesday and ask NVC what we should do. in the meantime I told Vladi to start looking for options at contacting Kazakstan and asking for the BC.

You (and any family members immigrating with you to the United States) must obtain an original birth certificate issued by the official custodian of birth records in your country of birth, showing your date of birth, place of birth, and parentage. Important Notice: All Immigrant Visa applicants must submit a long form original birth certificate. Short form birth certificates will not be accepted.

The certificate must contain the:

  • Your date of birth
  • Your place of birth
  • Names of both parents
  • Indication by the appropriate authority that it is an extract from the official records

Our IV and DS-260 have been approved, we are just waiting for them to review the AOS after we received the checklist, so probably another 3 weeks before Case Complete for us .... it's getting closer but still seems so far away!

Did you ever check if your "total household income" box was actually empty on your submitted I-864?

I'm the USC petitioner. My wife is British (now a USC!!!), generally awesome, and amazingly patient.

Through calling to NVC, I found out that they generated checklist for an error on AOS (I-864 form) and they explained me the error over the phone. However, I didn't get an email from them which will describe the checklist instruction. To save some time, I was thinking to send them back the corrected version of I-864 form including the cover sheet. My question to all of you is: Is there specific format to follow when we send them a response to checklist? I will appreciate if someone who passed through checklist process walk me through the contents of the checklist instruction letter. I also believe that the checklist instruction doesn't need to be sent back to them. Thanks a lot for your help!
