Hi folks... for some reason my ears were ringing.. saw an update e-mail from the forum and saw our name being mentioned. I called USCIS today and made a service request to expedite as the nice spanish speaking woman told me. So I have to laugh because she said I should hear something in 5 days. But if I don't hear anything don't call back she says. Just wait... wait wait wait.... sigh...

Hi Joe and Vlad. This is the response I got from my expedite request from USCIS.

"The expediting of a case allows it to be sent quickly to an officer for adjudication. However, your case is currently under review by an officer. Most applicants receive a decision or correspondence within 30 days. A timely decision requires all pertinent information being present when received by the adjudicating officer and the complexities of the case. Please contact us again if you do not receive the document or other correspondence within the 30 day time frame.

"The expediting of a case allows it to be sent quickly to an officer for adjudication. However, your case is currently under review by an officer. Most applicants receive a decision or correspondence within 30 days. A timely decision requires all pertinent information being present when received by the adjudicating officer and the complexities of the case. Please contact us again if you do not receive the document or other correspondence within the 30 day time frame.

We hope this information is helpful to you."

I think chrissyb got the exact same response (she received an RFE a couple days later). I hope this isn't the case for you. Is there anything you can think of that may need an RFE? :/

Yeah sounds similar to what I got. The status of this service request is:

Your case is currently under review. We understand that you have requested expeditious processing of your petition. You should receive a decision or notice of further action on your application within 30 days of the date of this letter as your Form I-130 is already assigned to an officer.

We used a lawyer to prepare everything (which doesn't guarantee anything I know) but we had everything asked for. The only thing I can think of is that we married 4 months after we met and we eloped so no one was at our wedding (we are still planning our "real" wedding with family). Also.... Ben came to stay with me in USA on visa waiver for a while never overstaying his 90 day visa. At the time the federal gov. did not recognize our marriage so we knew there was no chance for him to remain in the USA. On his last entry into the USA they told him he was spending too much time in the USA and couldn't come back unless he got another type of visa. He was allowed into the USA however and stayed less than 90 days before he went back to Sydney. That was last March. The lawyer said that this spending too much time in a one year time frame may be looked into but not affect us too much since he never overstayed an entry...and at the time Ben and I knew that he couldn't live here anyway. Well later last year the defense of marriage act was overturned and we were allowed to file. This is the only thing I can think of that they may be looking into.

I hope it's an approval, it sounds like you have all your bases covered! It's ridiculous they send a letter with your transfer notice that it should be adjudicated within 60 days and when that lapses you get another notice (after pestering them) to give it another 30. I call BS to the 100th degree!

I agree for sure! but its the government and they can do what they want. Officially on their customer service center info they say you have to wait not 60 days but 180 days before even being able to file a service request!! Ridiculous!

So after calling USCIS today b4 going to my info pass appt 2mrw I decided to call them first and the tier 2 sup advised they sent us an RFE notice yesterday. Of course case status hasn't been updated online but that was a relief at least our case has been acknowledged. Even funnier I think I may know exactly what the RFE is about. When we sent the initial packet they returned more than half of our evidence with a letter stating "the attached document(s) are a format we cannot place in your file folder for review by an officer during the adjudication process" mind you this was returned within a week of receiving the NOA1. So..... At this point, I'm willing to bet that's what the RFE is all about requesting the same dang evidence we initially sent :/

I called NVC for the first time today. Case received 4/11 but no case number assigned yet. The operator said I should get one on or around May 23rd so I guess they are still claiming it takes 6 weeks. Boo.

I was hoping we'd have a visa in hand by the end of August but it's starting to look unlikely.

I'm the USC petitioner. My wife is British (now a USC!!!), generally awesome, and amazingly patient.

Did you complete the G-1145 when you filed your I-130? If so, it's actually pointless to call to get your case number (I wish I had known this earlier lol). NVC will e-mail you as soon as your AOS is invoiced (which is about a day after the DS-261 is ready - that literally takes 5 minutes tops to complete). The e-mail has the Case #, IIN and Beneficiary ID.

There's nothing you can do on the site until the DS-261 is ready anyway.

But, if people want to call anyway, that's their choice, of course!

If you did not complete the G-1145 with the I-130, then NVC will not have your e-mail address and you pretty much need to call so when your case # is assigned you can give the Agent your (and your spouse's) e-mail address.
