September 2013 I-130 Filers

So I finally got around to contacting my representative in congress yesterday (Maryland Delaney - D). They were very quick to send the forms and I sent them back the same day. A day later (today) they called me. They called USCIS today. He called me back a couple of hours later and said I need to wait 30-60 more days and that our case is pending.

So I asked him why have I already waited since September and then its been almost 60 days since we were transferred to TSC. He said well you have to wait 5 months. I'm like then can you tell me why people with priority dates of October are already being approved? Why did people who were transferred to CSC already have their documents at NVC? He asked me how I knew this. I told him I follow the forums on VisaJourney.com and they keep spreadsheets. His response was oh I know this website they are misinformed! I was like so you're telling me hundreds of people are conspiring to put out misinformation and that the spreadsheets to track NOA1/NOA2 are all faked?

Needless to say I was more frustrated talking to him. He had no real answers for me. I'm left feeling that the conspiracy is with the inefficiency of their approval process. I know they receive tens of thousands of applications. But honestly how hard is it review these applications? If they had this set up digitally imagine how much faster it would go and you couldn't submit it until its completed.

Having recently worked for a government organization where I think about 50% of the employees were H1B Visa contractors, I felt compelled to ask him how long it takes to get one of those Visa's. There was a LONG pause. He retorted with its very complicated and loaded question. I was like so how is that I've been married to my husband since 2012 in Germany and we have to wait so long? I don't think companies are waiting 18 months just to get an H1B approved? I finished with telling him that the day I married my husband I could have walked into the city hall in our tiny village that we lived in and been granted residency!

He did agree the process was broken and gave me Congressman Delaney's canned immigration speech. I thanked him for being so quick to respond. He said he will leave my case open and call USCIS again in 45 days.

Good luck everyone.. I guess the TSC transfers got the shaft.

Joe&Vlad, my husband and I were in the same position as you less than a week ago. I had the same feelings of being tired of waiting and seeing all of the people ahead of us getting approved and then out of nowhere last Thursday, we were approved! I know it's frustrating but I know your approval is coming soon. It really is terrible that there is no rhyme or reason with how the USCIS runs things...very typical of the U.S. Government. Don't give up hope! Your time is coming very soon. We are sending good vibes to you and everyone else that is still waiting for an approval from the September filers. :)

Wow. Is Delaney up for re-election? Get the word out, as that was just an unacceptable response. I am so sorry this is happening to you :/ I do hope you see an approval soon. Maybe contacting the congress person will put some pep in USCIS' step.

Thanks for the support everyone... fingers crossed that the call from the congressman helps light a fire in USCIS.

What irks me the most is I work for an agency in DHS and our intranet site has a link to USCIS's internal pages. I can't help but think about it every day...

*On 08/01/14 I received a checklist via email and responded right away. Over a month later, on 09/09/14, I received the hard-copy in the mail. Upon reading the hard-copy, I found that NVC made a mistake and emailed me the wrong checklist. I contacted a supervisor at NVC and she instructed me to write a letter of explanation to accompany my "real" checklist response. She also told me this may not help me and that we may be back in line. Lord help us!

I am right there with you too. I got an RFE that I sent back to them on 04/22/2013. Its at the post office and supposed to have been delivered by 12:00 noon. I am watching usps.com like a hawk.
