My 10th day as well, maybe we'll get some good news!

So, we just received a hard copy of the RFE, and to say I am confused, would be an understatement.

This is what the letter says:

MARRIAGE CERTIFICATE: Submit a legible copy of the marriage certificate for the petitioner, X, and the beneficiary, Y. The certificate must indicate that after the marriage ceremony, it was registered or recorded by the appropriate civil authority as noted below.

According to the Foreign Affairs Manual, birth certificates from Estonia are generally available. Copies of marriage or divorce certificates can be obtained by writing to the Office of Vital Records (states the address of the place). The request must specify the date of the event and the names of the persons involved.

Americans who wish to marry in Estonia must present documentary evidence that they are legally free to marry. All foreign documents should be translated into Estonian and authenticated by Estonian authorities. Although no blood tests are currently required, there is a waiting period of approximately one month.

Same sex marriage is not recognized in Estonia.

Only residents of Estonia can apply for a divorce in Estonia. Couples without children or joint property may obtain a divorce through the Office of Vital Statistics after a three-month waiting period. In all other cases, a divorce must be obtained in an Estonian court.

So I guess my question is, that since they mention birth certificates and documents that prove that my husband was legally free to marry, is the marriage certificate the only thing we have to send them since that's bold and underlined or am I missing something?
This whole thing is so infuriating because I know for a fact there was a perfectly legible copy of our marriage certificate in the original packet ranting33va.gif

That's a confusing RFE :/ It's like they need your certificate and then changed gears and started talking about birth certificates. Did you get married in Estonia?

That's a confusing RFE :/ It's like they need your certificate and then changed gears and started talking about birth certificates. Did you get married in Estonia?

Yep, we got married in Estonia. I already sent them a copy of the official marriage certificate in English as well as my birth certificate, both in Estonian and English, so I have no idea what they want now :(

Yep, we got married in Estonia. I already sent them a copy of the official marriage certificate in English as well as my birth certificate, both in Estonian and English, so I have no idea what they want now :(

Was your husband previously married? Maybe you can call and speak with a Tier 2 tomorrow to get clarification.

Nope, it's the first marriage for both of us. Do you know if I could call them or will they only talk to him? And with him being military, if we call the military helpline, will that get us to the right people?

Sorry for all those questions, I just feel like I have no idea what is going on...

Thanks for posting this....I just got home from visiting my husband and came home to find the noa for the transfer and it said Nebraska...I just started crying. its bad enough I had to leave my husband again and then to come home and find out it was sent to such a slow sc. in tears.

Ok quick question. How is it that it says in the USCIS web site that they are approving a I-130 in 5 months for a resident, but for a citizen it takes 8 months. What the hell is that??? Shouldn't they give priority to a citizen?ranting33va.gifranting33va.gifranting33va.gif

Couple things here. #1 Never ever ever ever ever trust the processing times USCIS gives as they're way off. #2 When a permanent resident applies to bring an immediate family member to the US, there are only a limited number of visas available (whereas immediate relatives of USCs don't have a cap). The F2A priority date became current around Sept 2013, if I'm not mistaken.

Blueberry Pancake invited me to the party....our I-130 was received 9/9/2013, and our NOA was 9/25/2013. About 2 weeks ago, we got a notice that we were transferred to the Nebraska Service Center.

Just checked our case and we have this message:

Post Decision Activity

On March 17, 2014, we shipped this approved or re-affirmed case to the Department of State for visa processing. For more information, please contact them directly.

Does this mean we're approved? What the heck? I thought it was going to take eons.

((I'll go back and check up on the last 50+ pages of this thread that I haven't read....I just thought I'd post our news in case that helps anyone))

Edited to add that my husband is Mexican, I'm a US CItizen, and we live in a third country. I was under the impression that our overseas residency would give us priority in the process, but I recently heard that it only helps if you work for the government (i.e. military, consulate). I don't.
