September 2013 I-130 Filers

They don't do expedite requests because of a pregnancy, unfortunately. I already checked. sad.png I won't contact my Senator until it gets past 5 or 6 months. I'm hoping I get a quick NOA2, but like I said earlier, I doubt it will happen. No, I did not state that she was pregnant because I didn't want them to think we got pregnant just to get her a green card or something.

I'm so sorry they won't expedite because of a pregnancy. IMHO, I think they should. They do a very quick processing of an adoption visa for orphan adoptions--so you'd think they'd want an American citizen's child here....but ahhh....the system isn't always logical....

I'm also hoping you get a quick NOA2 letter so you and your family can be together ASAP. How far along is your wife now? I don't think anyone would think you got pregnant to have a green card. That'd be insane! I hope people don't do that...

Well, there's still a chance that you could get a really early NOA2 like I did and hopefully you'll have everything processed by the time that baby is ready to pop. Gosh, even at 13 weeks, it must be hard on her to be without you! I can only imagine. Stay strong and keep thinking that this is only for a while more.

Blueberry, I had the BEST sleep I've had in a while...woke up happy and ready to call the IRS this morning to request my transcripts for next steps at NVC! Can't believe I'm doing that now. I was holding off because I didn't want them out of date before needed. goofy.gif

Luv, yes...he came here and we got married in Vegas. We didn't mind where we got married, but, Vegas is, as you know, if you're from CA, THE EASIEST place to do it without any pre-planning. Since we weren't allowed to pre-plan...we didn't. We just went to Vegas, where you get your license in 5 minutes, get married in 10 and were married and had a little vacation at the same time! Actually, we were originally going to go the K-1 route, but were advised by a lawyer that doing it this way was faster a lot of times, especially since hubby didn't want to be here unable to work for a year while they processed everything. This way, we got married, started the process and he got to keep his job and maintain income. He has a good job there, so it wasn't worth losing a year's salary in our situation...I know everyone is different though. Maybe it's good that you are there with your husband, but, I do hope you get yours expedited on humanitarian grounds. Are you a CA resident? If you are, have you contacted Senators Boxer or Feinstein about your situation? If you haven't, I would....especially with the situation where you are right now....just an idea. Yes--Phoenix was good! California also has been good, too, so far. I wonder why you got sent to NBC and I got CA....

r060106, it is harder if your spouse is from a non-VWP country! crying.gif I really feel for you, especially with your wife preggo. I really think you might want to make a request to see if they will expedite...and maybe your situation is also worth a note to your local Senator....not sure where you are...but maybe worth it. You may want to wait a month or two more...and then write. Maybe you'll get a quick NOA2, too! Did you state anywhere in your application docs about your wife's pregnancy?

Myguita, according to what they told me on the phone, they just don't have a timeline for USC's in California. The other centers do have timelines posted online.

Luv, I do wonder if where the spouse is living makes a difference. It crossed my mind. But, I'm sure there's no way to prove it either way...just something I wonder...

No luv if u marry in the US and the foreign spouse returns to the home country everything is fine. If u plan ur marriage and your spouse is getting to the US and stays there then it is against the law.

If ur spouse is coming for a visit without the intention to get married in the US but it is happing during the visit then u can file for a green card then ur spouse can stay and u could file from the US

Yes, Murf & Reggie's answer is correct, Luv. It's illegal for him to come with the intention to stay. In our case, we didn't want to have him stay due to him having a good job. Didn't make sense to lose a year's income while he was processed. So, he didn't stay and we did the process as it was recommended by a lawyer...
