I overstayed and cant use my VWP again. I have requested for my FBI report and this is what it says on it?...

1- ARRESTED OR RECIEVED WITH THE DATE....BLA BLA BLA..

AGENCY - USINS - INTL AIRPORT PHILADELPHIA(PAINS0100

AGENCY CASE - 312314569

CHARGE 1 - ALIEN INADMISSIBILTY UNDER SECTION 212

Can someone explain to me what this means as I was not arrested by a police officer but by the custms officer who refused me entry and told me he will put me on the next flight home as I have overstyed before and need to go home to get a visa to come back????

In the USA if a custom officer detain you and you back in the UK the next day , will this reflect on your FBI file as an Arrest..

So far that is what I got.. that incident. My FBI was requested onthe 1st of August 2006 and got answer back on the 5 of dec 2006 5 months I guess. Any time frame for FOIA?? This was requested in April 2006, and so if it takes 9 motns i must be thinking next Feb,, Is this true.....

you will see it says in the second line: Agency USINS

that's united states immigration and naturalization services, so they're aware you were not arrested by a police officer but by an immigration officer.

[thank you for your answer,, just checking do anyone have a clue what will be written on my file request for FOIA, as i was told by the officer I need to get a visa to come on a visit to the USA. and that i am not ban....

Can more be written in terms of this,,

All I want is will it be similiar to the FBI record?????

my man was refused entry but NOTHING was stamped in his passport(no 212 stamp or anything). Everytime his name was put into a computer(even last week when we applied for his SS#) a red flag comes up b/c he was denied here in Philadelphia 2 years ago.

I would think that this info WILL show up on an FBI record just because your name is in the system. I might be wrong.

I told you before you shouldn't have a ban-the 212 stamp just means that they thought you had immigrant intent.
