Hello VJ Members,

I need your help please, I am stuck on part 4 question on my I-751 paper work asking information about your children. I am the beneficiary of this application, Yes I do have 2 children, however they do not live here with me in the USA. Do I still complete their names on this application? Or do they only need the details of my wife's daughter, my step daughter who is a US citizen? Or do we list both our respective children on the form?

Please advice. Thanks in anticipation

Hello VJ Members,

All children must be added. Yes, add both these 2 children also and then select "NO" to questions 5, 6, 11 & 12 - "Is child living with you?" and "Is child applying with you?".

01/08/13 - Approved and GC is order for production on 1/8/14

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

I read some posts before saying no need to list children born in the US from your marriage, right?

You need to list all children now - the I-751 form has been revised to accommodate this and remove the confusion that was there before the revision.

USA

01/08/13 - Approved and GC is order for production on 1/8/14

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

So if the child was born in the USA from the marriage and is a US citizen, we still need to list this child in the application but answer "No" for "Is child applying with you".

Because of the confusion before, the US born children got listed in the application and got the fingerprint request as well which should not be which caused a lot of trouble before.

Are you 100% positive that the US born children need to be listed in the application?

Are you 100% positive that the US born children need to be listed in the application?

I am 100% positive and am telling you with personal experience - I submitted wife's application with our child born here and only my wife's biometrics was scheduled and done.

Please note that the birth certificate of a child born in the marriage is a great evidence and if that is used and the child is not reflected in part 4, you may get a RFE seeking clarification.

Yes, during the old form this area caused confusion (in old form we are supposed to include only the child that is applying with parent) and hence USCIS had modified the form in this area.

We listed my US born children. They are my husband's stepchildren and we had supporting evidence that included them as well, such as them being beneficiaries on his life insurance and my(our) daughter being on his vision plan through his employment. We had no problems at all listing all our children. You simply state if they live with you or not and check NO for them applying with you. Also, US born children will have no A#, so that will be left blank as well.

Thank you very much for the clarification. We do have a child born in the US in our marriage but no other children. I am glad that I asked otherwise we would miss that. It would be better for USCIS to clarify that in the form instructions. Thanks again.

We listed my US born children.
