I have also same prob. My fiance's income is below minimum household of 3 . Our co sponsor is my fiance's mom, her annual income is around 39,000$ but she have 3 sons (my fiance's siblings) who is PARTIALLY dependent on her since she and her husband are temporarily separated, the 3 sons are WHOLLY dependent on my fiance's dad. This will affect our k1 petition? My scheduled interview is on September 10th.

Thank you, hope to hear from you guys...

Assuming you are talking about USEM, since you are in the PI forum. But a timeline and a country you are applying for would help us help you.

USEM typically doesn't accept co-sponsors. But if you try, the sponsor and co-sponsor combined income must meet or exceed the 2013 125% poverty level for household size. Currently $24,412 for a HH of 3: http://www.uscis.gov/files/form/i-864p.pdf

The co-sponsor must list all dependents on her I-864. So if those "semi-dependent" kids are claimed on her taxes, they are her dependents, and her HH size just went up. It gets trickier when adding it all up, you need to read, read, then re-read the I-864 instructions. Form & Instructions

Thanks.. Our co sponsor's dependents are claimed on her taxes but in our form she states that her 3 sons are partially dependent only because she and her husband are temporarily separated, and we have also this kind of letter (notarized) of her husband stating that "my wife and I filed our last income tax as joint/married and claimed the 3 boys listed above as our dependents , but the rental and utility support I am providing is intended to relieve my wife financial burden which is my responsibility." This helps? Sorry , little confused about this one....m

Now my question for you (if you don't mind sharing for the benefit of others) is:

How much income was listed for the petitioner, in % poverty level? Was it 100%, 113%, 125?, etc.?

Hi DavenRoxy, for HH of 3, his income was 109%.

To be sure that the consul will approve us we had our co sponsor (HH of 4 --> me, our son, sponsor and the co sponsor) and her income is 166%.

I think you only have to complete the required documents so that the consul will approve your visa. :)

Congrats chix2324! :) when is her CFO ?

Did they actually require a cosponsor? According to an email I received from USEM, they only require 100% of the poverty level.

That is my question also, if they took the co-sponsor stuff then 106% isn't making them happy.

Yes, they require me to have a co sponsor because 106% for HH 3 is a little low. USEM requires the sponsor 125%. That's what they told me. Good thing, I bring all the documents of our co sponsor that the embassy want to see--even though I read and heard that USEM doesn't allow co sponsors.... :)

And there you have it, folks... even though USEM emailed me saying they only require 100%, at least one CO required JNd to have 125%. I really wish I knew the name of the CO whom your fiance talked to. I'd love to email them about their inconsistencies.

And somewhere on the USEM website I had read the 125% requirement also, as well as the 5X for assets... trouble is the USEM website is very screwed up, I will have to remember to bookmark it the next time I trip over it.
