I am 40 years older than my finance...he is from nigiera..will this stop him from getting a k-1 visa?

Strictly speaking, no. However, there have been a high rate of visa denials in similar cases (large age difference, petitioner is significantly older than beneficiary, beneficiary is from Nigeria).

June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

By the letter of the law no. But in Nigerian culture it is very important that a man produce children and you are beyond child bearing age. Have you met his parents and siblings during your trips or have you just stayed in hotels.

This will not be over quickly. You will not enjoy this.

Go back there and get married then file for cr1. That's your best and only chance. Two red flags on your shoulders

- The country from wich the beneficiary is from!

-The HUGE gap of age between you.

File for cr1 and frontload your package with tonnes of evidence and hopefully that might work out for both of you.

It's going to be very hard with that red flag. I'd suggest gathering a bunch of evidence if you plan to follow through with the K-1. If not, then try the CR-1 as mentioned above and document every part of the marriage!

My fiance (Male - USC) is 32 years older than me and we aren't thinking to much about the age red flag cause we have many vists to each other in last 3 years. Just front load or give as much bonafide evidence as you can.

When a man is older than a woman there is the assumption that he is still sexually capable and classic relationship views always have old men marrying much younger woman for protective and reproductive purposes. In many cultures men marrying a bride the age of their grandchildren is very common. Usually a man has things that a young woman is will to accept in return for dealing with an older man , a good deal of wealth and strength in the community.

When it comes to a young man marrying a woman the age of his grandmother, that swims upstream of all social norms. The man is at least for the moment giving up his ability to increase his lineage. Usually woman are not as secure in their old age as men are. Post menopausal women aren't the same sexually as ones still in their child producing years. With over half the non Nigerian 2 Nigerian relationships being fraudulent on the part of the Nigerian every red flag should be carefully examines. These are the people that can sweet talk peoples entire life savings out of their pockets in the chase of hidden treasures that have a few issues in getting to them. There are some legit US /Nigerian couples with decade or more age differences with the woman being older but for every legit one that passes through here there are a dozen where the man will be gone before the ink on the green card is dry. The embassy knows this well and will surely closely investigate his claims of love and if you are not integrated into his family for all your visits then you have little hope of getting him here even with a lengthy AP that is sure to come for field investigations.

This will not be over quickly. You will not enjoy this.
