Hey guys I'm new here. This is whats going on with my family.

My mother filed for a petition for her brother in 93, they got the paper work and everything, but the issue we are having is this, her brother/my uncle has two children and he could only bring one of his kids, the other kid turned 21 in July of 05, and in december of 05 they arrived in America, he was only 4 months off, so I was wondering does that fall under CSPA (child status protection Act)? What do I need to do? Is there a way?

I would really apreciate any kind of help you guys.

Since the USCIS website has been updated, I googled "Child Status Protection Act" and found this:

Alternative to googling, why not consult an immigration lawyer as they are best placed to answer these kind of questions.

At 21+ years old he hardly qualifies as a child. There are others here that brought a child to the US and applied for AOS (Green Card) prior to turning 21 but while waiting for the government to process the case the child turned 21. In at least one case they have been told by immigration the 21 year old must leave the country. We all know this shouldn't be, but that's what they were told. As I understand it that case is now in the federal court waiting for an answer.

I don't see how this individual at 21 already will get any consideration under CSPA.

Well, I think you may gain some useful information from reading this. CSPA Q&A

From what I read, it may be possible that your nephew is covered under the CSPA, if the I-130 was filed prior to his reaching 21.

I would seriously, get in touch with an immigration attorney.

My son turned 21 during processing, whilst he was here in the US, and the CSPA doesn't cover him.

Our journey started in 2001 and it's still not over. It's been a rollercoaster ride all the way! Let me off - I wanna be sick!
