I have to apply for roc on sep 20 i started collecting proofs of bonafide marriage and i was wondering should i notarize the affidavits from our friends?

Notaries verify signatures on documents. They have nothing to do with content therefore its meaningless to have such things notarized. This is why there is no requirement to do so nor to submit these affidavits. Anyone can write anything but it doesn't mean its true. It also doesn't hurt to submit such letters if it serves to make you feel better.

Notarizing is not necessary. Affidavits are considered very weak evidence. Include them if you want but they hold little weight, as do photos.

Well i have enough evidence, but i thought i could add some affidavits but if it's not considered strong evidence i might reconsider it

I suggest that you send the affidavits too - no need to get those notarized but must be from US Citizen/s. Actually in the ROC instructions, affidavits are still mentioned as requirements.

Affidavits are NOT requirements. No single document is required. There is a list of documents you can submit that can help prove comingling. Affidavits are still weak evidence and do not need to be from US citizens. To state otherwise is misleading.

I have no ideas how you drew this conclusion.

Please go to USCIS web site to the I-751 instructions and go down to part "Evidence of relationship" item 5, which is in page 3, where it is clearly mentioned that "Affidavits sworn to or affirmed by at least two people.......".

The conclusion was drawn from speaking with immigration officers and referring to the website you pointed to. No single piece of evidence is REQUIRED (and no lack of a specific document hurts you in particular). You do not HAVE TO submit affidavits. They may, along with other documents, bolster the credibility of your bonafide marriage and co-mingling and can be included but are not a strict requirement.

Nor does the affidavit that you may submit have to be from US citizens. That is just plain wrong.

I find the responses to this post interesting. After getting an RFE myself, I don't think there is such thing as "not important" or "not strong evidences". To those that didn't submit such things as notarized affidavits and photos and got approved, good for you. To those that didn't submit such things and got an RFE, well do you really know why? Probably not. Funny someone should say the affidavits don't hold weight because there was another petitioner who thought maybe the affidavit they submitted for the RFE was what got them approved. You just never know...

I would suggest (and I have seen several support this idea) to submit anything and everything you can that are suggested evidences on the I-750 instruction sheet. And don't allow inconveniences to stop you. If you can get them but it takes some effort to get the documents, then do it.

Go get the affidavits notarized, whether it helps or not. Banks can do that for you.

Thank you all for your help I just spoke to our friends who did the affidavits and i'm gonna notarize those and send them anyway with the rest of the paper work if it didn't help it wouldn't hurt

After reading the instructions I don't necessarily see that it's saying it's required to send affidavits. It asks for as many documents as you can... should include but not limited to. But it doesn't say it requires. I'm sure if you don't have a lot of other documents to provide then the affidavits might help. For my husband we did not send affidavits. We sent the birth certificate from our son born after we were married, our lease from our current home as well as a letter explaining our living situation prior to our current residence, tax transcripts from the last two years and a letter explaining why we did not have tax transcripts for the first year, bank statements/credit card statements which I provided for every quarter (some send every month, we did not). We had a lot of documents showing co-mingling of finances through several credit cards, bank accounts, medical/dental/vision insurance, car insurance, membership cards, and our ids showing the same address. We sent very few pictures and no affidavits. We must have had enough proof in the documents that we sent to show a good faith marriage whereas I'm sure those who don't have as much to show, the affidavits might help.

Well said. Yes no documents is a must other than the very application, fee, copy of green card (front and back) along with some good evidence from among the suggested ones in the instructions. Ultimately what matters is that an application needs to let the USCIS to conclude that one is a genuine marriage.

I read a lot of thread/ RFE cases and I see that in a large number of cases the RFEs were received for lack of proper clarification in the covering letter regarding the absence of a certain important pieces of evidence rather than the absence of those. Yes, common sense plays a big role. And when we help others we review their individual case against similar others and not against the idealistic ones.

Did I need to send the affidavits? - no, as I had tons of evidence. Did I send affidavits? Absolutely yes, as I want a quick and clean approval.

You think the purpose of the notary is what exactly? These affidavits are simply statements by unknown people about subjective information which is why they are of little value. A notary doesn't even read documents nor have anything to say about the content.

I can write a statement about this situation and have it notarized yet have no knowledge at all of the actual situation. A guy in a bank will charge me something to watch me sign it. What good is this effort? Its meaningless.

Of course people want to believe these statements help. They also believe in the tooth fairy, Easter bunny ect.
