I am a contractor that currently works in Afghanistan. My fiance and I will be coming to the states soon on her K1 visa, getting married and filing for the AOS. By the time we have our interview (if we have one) I will most likely be home from Afghanistan, so I will have to use my assets to meet the requirement to sponsor my wife.

I know it states the following in the instructions for the I-864:

You can count personal assets and/or the income and assets of household members who have signed an I-864A. In most cases, the sponsor must present evidence establishing location, ownership and value of each asset listed, including liens and liabilities for each asset listed. The consular officer will need to determine that the monetary value of the asset could reasonably be made available to support the sponsored immigrant and readily converted to cash within one year, without undue harm to the sponsor or his or her family member.

If I am looking to use my house as an asset it seems like that would not cause harm to the sponsor because we could always rent a house.

If you lived in your Primary residence and wanted to use your house as an asset (include appraisal and loan document showing how much you owe) and used your house as an asset, can you please chime in and state whether or not USCIS accepted that as an asset.

Thanks a lot in advance.

Mike

Hello Mike,

Outside your question, as I have not use any assets as an sponsor...here it is

If you are a contractor in Afghanistan you should not worry about meeting the income requirement (the Poverty Guidelines - I-864P 2012 has a minimum income requirement of $18,9112.00 for a household of 2) to sponsor your future wife.

I don't know how long you've been overseas; I have been in Kuwait as a contractor for a minute now and I have been able to sponsor quite a few family members with just income along.

Just a thought, it will be easier if you can go this route.

Best of luck.

Kel

Well my contract is ending around the 4th month of the process. I have seen intervies right around the 3-5 month mark and I am 99% sure they are going to ask me about my job considering its based out of Afghanistan, and as I am sure everyone knows, it's not good to lie to USCIS during the interview. So that is why I am having to submit Assets too.

Cannot say if the IO would accept the house or not. They may or may not. I do know you have to provide the appraisal and any lien documentation in order to arrive at the net value of the home.

Hopefully they will either accept the I-864 as it is by approving the green card without interview, or not ask for updated financials at the interview if you have one. If they do want current financials, which are not always asked for at the interview, then just provide them what you have and hope the IO accepts it.
