I received out of the blue today, a Termination of Conditional Resident Status letter stating that basically I am being deported. The letter states the following:

A review of the records of the Immigration and Naturalization Service reveals that you were admitted to the US as a conditional permanent resident on 8/22/2004.

In accordance with the provisions of Section 216c of the Immigration and Nationality Act you and your spouse through whom you obtained your conditional ....etc etc etc..

I was out of the country of the US when my residency expired on 8/22/06, being gone for three months. I had to go to the Sydney, AU consulate to be allowed back in the US. I was to just told to renew my card, nothing about the possibility of being deported, and was told the same thing by the border control when entering the US. Now I don't know what to do, anyone have any experience with this? I think I need to get a lawyer tomorrow morning. I have a 16 month old child with my US citizen husband, the child was born here in the US.

You are definately going to need a lawyer. I believe that you should of filed to remove conditions 3 months before expiration of your card.

Did you not get informed about the procedure to remove conditions of your 2 year greencard when you first received it?

When I got my visa, they told me in detail what is to be done in two years time...

I'd advise you to contact a lawyer and read through the documents you should have submitted 3 months prior to the expiration date of your gc... I-751 (I believe?).

April 2003 - fell in love

Aug 2004 - go to the US for internship

Feb 2005 - both return to Germany

Aug 2006 - getting married

No information in the letter of Termination of Conditional Residency of the procedures available to appeal the decision? Get thee to an immigration attorney!

this is very disturbing.... how come your USC didn't file to remove your conditional greencard 90 days before expiration date?????? Unbelievable some people!!!! Let's this be a lesson for all including myself!!!

The USC half of the equation cannot remove the conditions, only the immigrant half can. Its her green card, not his.

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card

Oct 29th 2004 -Met online
Oct 29th -First phone call
Dec 25th -She purposed and i said Yes!
May 10th I-130 Packet and Packet 3 sent off to me by the U.S. Consulate
May 16th -Received Packets 1-3 from the U.S. consulate
June 29th -I arrived in Puerto-Rico!
July 2nd -Married in Mayaguez, Puerto-Rico and also got our interview date for September 6th
August 17th -We arrived in Australia to file for Sep. 6th
September 6th - Filed DCF in Sydney and approved 1 hour later!
September 12 -Received my passport with the visa and yellow packet
November 24th -POE.......Guam,USA
December 12, 2005-Green Card arrived in the mail
September 11, 2007 -Filed I-751 on conditions
September 17 -VSC Receives my I-751 and issues NOA1
Oct 10 -Had biometrics taken in San Juan, Puerto Rico ASC

Well we contacted the local Congressmans office, they happen to be part of the committee on Homeland Security. They are going to be speaking to the INS on our behalf to help us figure out our next step. A lawyer will be hired soon, just waiting on the word from the Congress aids.

The Congressman's office cannot speak to an entity that no longer exists, nor can the Congressman's office get the current entity to violate the law.

The ball is in your court to grovel and beg forgiveness. Lawyers are good at this, so get moving with someone who can actually help you.
