We all know ICE doesn't go around knocking on doors and picking up people, or southern California would be a ghost town. There is more to the story you aren't telling and the fact that you were picked up points to the fact that ANY visa to the US probably isn't in your future.

Well It is no their job to clean the streets, but to decrease it.

Whatever I wrote in my topic post is true. Here is the the timeline.

March 2010 - Missed classes

May 2010 - Realized out of status - applied for reinstatement

August 2010 - Got a reply back to submit papers to support my reinstatement

August 2010 - Submitted papers

September 2010 - In the mean time Ice came and picked me up

Before realizing I was out of status, I thought they give warning at first.

What can I do to show the consulate I will not violate the terms of F-1 visa?

Like in real words. I really learned my lesson. I did not know missing classes could lock you up in the immigration jail. There is always a learning for the first timers. I will think 2wice next time while taking any silly step.

That isn't going to help your case. Not only will they not believe your 'I learned my lesson', it was made very clear to me what would happen if I violated the terms of my F-1, so simply saying "oh well, I was learning, it was my first time' is arrogant.

Usually after something like this people wait a good amount of time, perhaps take some classes in their home country and how the consulate they are now serious about school.

ICE do not go around picking up Students for missing a few classes.

Out of status, assuming you were, for more than 6 months is a 3 year ban.

There is a non immigrant waiver if you have a ban.

You would be better off applying in your home country where you have all your ties etc etc.

No as per the F-1 visa law, it seems to maintain status, you can't miss more than 4 classes in a semester.

Thanks boiler, I was thinking about applying from there too, sounds sensible.

How does complying with the Immigration judges rule-out and accepting voluntary departure, put you on the black-list?
