Does anyone know a definite answer if you can used the GI Bill as an income for financial support of the K-1 fiancés visa? There are threat regarding this, but some say yes others say no. I would appreciate an answer from those that have used the GI Bill as prove of support, or someone that knows 100% of the answer. Thank you!!

I worked part time (10,000) GI Bill (16,800)

Post 911 G.I.bill benefit is not taxable, therefore you can NOT claim as an income.

Payments you receive for education, training, or subsistence under any law administered by the Department of Veterans Affairs (VA) are tax free.

To be clear here this means you do NOT claim GI Bill benefits or other government funded education benefits as income. This also means you can not take deductions or credits for expenses that are paid with grants or VA benefits.

Whether or not income can be taxed or not is not the determining factor for whether or not something counts as income for the affidavit of support. Disability, SS retirement, child support, etc. Those are all counted as income on an affidavit of support. It is not as black and white as taxable/nontaxable.

The main problem with the GI Bill is that it is a temporary income, and the bulk of the money you receive is used for attending school and paying tuition and not actual income in your pocket. I would not count on the GI Bill amount being accepted for the affidavit of support. You should try to find a co-sponsor.

Hey

we used my fiance's GI bill on the I-134 along with his tax returns of previous years from being in the military. Was fine to use and we didn't even make the amount they like to see (but did in 2012). For that reason, we used his parents as co-sponsors, though the man interviewing me murmured that I didn't even need the co-sponsors!

To be on the safe side, I'd attempt to find one co-sponsor, but I think you're set :)

What does taxable have to do with anything? VA Disability & S.S. retirement isn't taxable (with exception) either and both are TOTALLY acceptable. You are wrong in so many ways...

hi.. I know this post was been over a year..

my situation is I filed a k1 visa september

I just got out from army.

can I used my G.I bill and VA benefits (disabilities check) on affidavit of support on my fiance upcoming interview? and

ITR 2013 ? and since I'm out of the military the poverty guidelines i will be using under category 125% poverty guidelines household siZe 2 : $19,662?

You can include, however, I suggest you also look into co/joint-sponsor.

I know this treat is old but i need just wanted to know if anyone used the GI bill on the I 134. my total income for last year is as follwed

Last year: work ($18,000) + GI Bill ($11,000) Bank Account ($15,000) Asset $($10,000)

Right Now : 2 Jobs Job1 (permanent): $400 week Job2(internship): $450 week GI bill $1,500 month

do i need a co sponsor, though i don't think i can get one.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
