In the second link please refer to page: 12

The first link is for an internet legal advisory. This is NOT the same thing as a U S C I S R E Q U I R E M E N T (not even close).

The second link is an internal USCIS presentation that establishes internal procedures. The page you referred to (Page Twelve) is not a stated requirement at all. It simply lists a table of contents, if you will, for various sections of the new training manual. It's not even close to a requirement.

I can't believe you would attempt to pass this off as an actual requirement by the USCIS. I suppose this rather weak attempt on your part is a concession that you really do not know what you are talking about and are simply trying to save face.

My original challenge still stands: point me definitively to the USCIS requirement where it is indicated that a future anticipated event such as a change in marital status must be disclosed by a petitioner to an Immigration Officer at the Naturalisation Interview?

Page 74: Advice you to let USCIS know about your marriage status and give marriage certificate so the new naturalization document can confirm your new name (in case the applicant is a female).

Now Darth Vader Ku don't feel like I told the applicant that they have to disclose it, all I said is you can and not disclosing it won't affect your naturalization as chances of getting denied because of that are near 0%.

I can't accept how you come and push your ideas on people without even going through the whole process. I based my answer to the original poster based on info that I collected from peoples processes. It's well know that some people didn't get the benefit they wanted just because they forgot to mention a little thing that they thought it's not important.

As I said to the original poster telling the officer will give you a chance to learn about what to do in this specific situation and that will give them a chance to cover their rear from USCIS blaming them in the future for not disclosing that.

I'm sorry if I sound to harsh but when somebody comes and tells me you don't have to do this and you will be fine, let me ask you this: WHAT DID YOU BASE YOUR ANSWER ON? Do you have a law that you hold in your hand? do you have an example that you based your answer on? Do you know any specific situation as the original poster's situation?

At the end my friend, you are trying to"save a face" based on baseless allegation that you can't even prove.

Please if you respond be sure that I won't be able to respond soon (maybe tomorrow).

Besides my friend the fact the questionnaire asks you about your marital status is enough to prove that you are wrong. At the end as you said it's up to the applicant to decide whether they should disclose it or not.

I'm basing my answer on four very simple documents, all issued by the United States Citizenship and Immigration Service:

1) The N-400 Application Form

2) The N-400 Eligibility Worksheet

3) The N-400 Application Guide

4) The USCIS web pages on Naturalisation

I read all these ages ago comprehensively to immediately be one hundred percent certain that your claims in previous posts were unfounded.

Also, the questionnaire does ask you about your marital status...your C U R R E N T marital status, not a futuristic expectation.

Please, continue to respond to save face, and I will continue to reply with facts that show the lack of merit in your statements. The very simple truth (which you and I both know) is that you are very wrong and are simply exploring ways not to appear...uhm...uninformed.

I was the 3rd or fourth person to have interview in this september 2013 group seems like i am going to be a last one to be naturalized because of a request for a name change, in my area court house do the ceremony after 3 months .. the last one was in sometime in March and i was not invited . and Next one will be May , So thats next month and i am glad that i got this email update today ....

hi Silkafi88,

I have my interview coming up in 20 days. I am applying based on 5 year eligibility but I got my 10 year green card through my ex-husband's job. We got divorced last year in February. I got engaged a month before filing my N-400 and i will be getting married 10 days after my interview. I wanted to ask your opinion about disclosing my wedding plans at the interview. I want to volunteer the information especially since my fiance is an American Citizen by birth and I dont have anything to hide. During the interview did your IO give you an opportunity to disclose relevant information?

Any input would be appreciated.

Congratulations on your upcoming interview and marriage. I don't know if your requested input only from Silkafii88, so I apologize if you did and please ignore my opinion. Since you already disclosed on your N-400 that you were divorced and you will not be married at the time of your interview, I don't see the point of disclosing future wedding plans, since you will have to disclose on N-445 form before your Oath Ceremony. Unless of course you have a same day Oath Ceremony, then you would not be married until 10 days after and would not really apply.

all opinions are welcome! They dont conduct same day oath ceremonies here in New york City. My only issue is that i might have to request them to delay my oath ceremony since I will be traveling out of state for a week after my wedding. that is the only reason that I feel I may have to let them know.

Besides at the oath they ask you if your natural status changed regardless of 5 year rule our 3 year rule

thank you for clarifying. I have to leave the state for a week after getting married. They dont have same day oaths in NYC. So i may have to request them to delay my oath ceremony till after memorial day. That is one of the reasons that I felt I need to disclose why i am planning on traveling

I disagree with this point of view.

To the Original Poster: if you were applying under the three-year statute, I would concede that your expected and upcoming change in marital status would be material information to disclose. As it is, you are applying under the five-year statute, and your new, upcoming marital status (regardless of the nationality of the individual you were marying) is not under consideration for your eligibility.

Not disclosing does not equate to not being truthful. If you have answered every question on your N-400 petition correctly (under the letter and the spirit of each question), and as long as you answer all questions in the same vein at your interview, proactive disclosure of this information is not required.

I have been thinking about it and I agree that I dont have to specifically volunteer the information because it might over-whelm the IO. its not like my marital status has changed. I would still be divorced when I have my interview. I will only tell them IF it comes up in questioning but I will bring my fiance's documentation to avoid a RFE.

That it took me 5 months to have oath after the interview is only because i requested for a name change,
this is what delayed my case by months

28 April 2010 AP completed just out of blue.
30 April 2010 Visa received


21 Months Total from start to VISA received


8 Months in AP TOTAL 239 Days
