My husband sent out for both his EAD and AOS over two months ago. His biometrics appointment was on July 11th and his EAD was approved without any further inquiry on August 15th. My question now is how do we know if he will have an AOS interview or not? I know we will receive a letter if he has an interview but does he get a letter if he won't have an interview. If so when should I assume we would receive either letter. Thank you.

We sent out our AOS package in April, had Biometrics in May and received an RFE, which we responded to straight away, received EAD in June and got a letter a couple of weeks ago saying that my case has been identified as a potential interview waiver case and to not expect to hear anything further for 6 months. So I am assuming those who receive the waiver will get the same letter I did and those that get an interview will receive the interview schedule letter.

Only the k1 visa holder who are adjusting can have their interview waive. But you can also have one. That's the 2 options. I adjusted from my k1 visa on july 2012, got my EAD on sept and never heard anything from my case til april when I got my Green card by mail with welcome letter. It was a little bit frustrating not knowing anything from it for 7 month (not even a letter, notice, rfe, email etc) so after 5 month I assumed my interview was waived. It was funny, cause my husband saved his last day of vacation for months, just to make sure he had a day off from work so he can go to the interview with me. I also had almost everything I needed including wedding albums, and a lot of documents that we possibly need to proof that our marriage is in good faith.

I heard that applicants who enter the US with K-1 visa do not have an interview. Maybe wishful thinking? Also a letter about a notice of visa interview waiver comes to you.

Don't count on not getting and interview, most do.

We don't care if my husband has to have an interview or not (he is the Chilean citizen) we just don't want to know if we have one or not the waiting is stressful. I don't want to wait around thinking we haven't heard anything and then missed our interview. They mail everything directly to our house rather than our mailing address as we had request and mail coming to the house has gotten lost several times that is why I ask. I don't know how long I am supposed to wait to hear. If you do have an interview set does it change the status online?

As a K-1, there's about 50% chances not to have an interview. Not having one results in a long wait (sometimes more than a year). Having one generally results in a short wait (a few months).

There's no way to know for sure if you will be scheduled for one or no until you either get an interview notice, or your green card approved.

Yes, if you are scheduled for an interview, the status online should change. Be careful though, the online status system is far to be reliable. Sometimes it just doesn't work.

That's half true/wrong. You may be scheduled for an interview when adjusting status from a K-1.

I have been waiting for almost six months without any updates, but I have not received the famous "Interview Waiver" letter, so I am still assuming I am getting an interview. Better be prepared than sorry.

If you have an interview, the online status should change to "Testing/Interview", but as someone else said, the online status is far from reliable. My case does not even show up online at all. So don't rely on it. You will receive a letter if you are chosen for an interview.

Soojung, he was giving a thumbs up (means he agrees with) to big dog, not you. He highlighted in red your statement, because it is wishful thinking. Many K-1 AOS filers have to do an interview. Might depend on locality, business of USCIS... IDK. But I know that all 4 K1 couples I know personally all had to do an interview. Three had to do biometrics multiple times.

If I misunderstood the reply, I am so sorry. I would like to leave some cases that I have heard. I never said visa interview waiver happens to every people.

It depends on the cases. When I talked to people these days, they received green card without having interviews. That's what I meant.
